Man arrested after spitting on sidewalk in Daytona Beach

DAYTONA BEACH, Fla. -

An 18-year-old Daytona Beach man was arrested after he violated a city ordinance by spitting on a sidewalk, which police said created an unsanitary environment for others in the area.

According to Daytona Beach police, Austin Kennedy was walking in the 700 block of North Grandview Avenue when an officer saw him "pressing his lips together and creating saliva." Kennedy then "with force discharged the saliva from his mouth," according to police.

"It is a rarity, but it depends on the officer's discretion," DBPD Police Chief Michael Chitwood said. "We don't drive down the street looking for people spitting."

The thing about spitting on the sidewalk dates from the days of widespread tuberculosis - it is one of the disease vectors.

chew tobacco and dip snuff. A century and a half ago there were spittoons in bars and other businesses for that and it could get rather sticky to ones feet and was hazardous because so many people used tobacco in this way. Some places need to update their laws. We are in a different century.

It's hypocritical that Florida would elect a person that committed millions of dollars in Medicare fraud yet makes sure we are safe from people that spit on a sidewalk.

There's nothing worse than almost stepping on a big wad of spit on the ground. Pretty nasty. I especially wouldn't want it where people might walk barefoot.

I don't think they are chewing tobacco, I think they just spit. It is gross, they should get a ticket also people that litter, what is wrong with people. Can't they take care of their own bodily fluids and junk? Dropping their used chewing gum too.

Chitwood said officers were in the process of arresting someone when Kennedy started "mouthing off" at them and then from five yards away, spit toward the officers. He said the officers could have arrested Kennedy for disorderly conduct or interfering with police business, but instead, the chief said, they gave him a break.

Kennedy was arrested and taken to jail, and issued a $100 citation.
