Georgia judge orders Obama to appear in court on a birther suit.

Can this be for real? Are these people that crazy?

COLUMBUS, Ga. -- A Georgia judge has ordered President Barack Obama to appear in court in Atlanta Thursday for a hearing on a complaint that says Obama isn't a natural-born citizen and can't be president.

Orly Taitz, the California attorney who brought the legal challenge to Obama's name on the March Georgia presidential primary ballot, says this is what she has been working for over the last three years.

"This will be 100 times bigger than Watergate," she said Saturday morning, referring to the scandal that brought down President Richard Nixon in 1974.

"There are high ranking judges and federal officials who are involved in this cover up. The ramifications of this trial will be enormous."

The judge issued no such order.

He denied a motion to quash a subpoena, and that has been misinterpreted.

Reporters that haven't been sufficiently Orly-proofed are prone to missing important details.

The administrative law judge in a "ballot challenge" proceeding denied a very casually-written motion to quash a subpoena which did not require Obama's presence at the hearing in the first place.

In Orlylaw, this means the judge ordered him to appear.

There will be major lulz coming out of this later in the week. Stay tuned.

Even though President Barack Obama has been summoned to a court hearing here Thursday, don’t expect the Commander in Chief to come.

Obama will embark on a three-day trip following his State of the Union address Tuesday evening, White House press secretary Jay Carney said during a press briefing Monday. The White House has said that Obama will be in Las Vegas, Denver and Detroit this Thursday.

In a surprising ruling Friday, a Georgia state administrative judge declined to quash a subpoena directing Obama to attend a hearing Thursday at the Fulton County courthouse on a challenge to strike him from the Georgia ballot this fall on claims he is not a U.S. citizen.

Deputy Chief Judge Michael Malihi issued the decision after previously declining to dismiss the case, one of dozens around the country brought by so-called “birthers.” Malihi, appointed in 1995 by Gov. Zell Miller, presides at the Georgia Office of State Administrative Hearings, which hears complaints against state agencies.

The judge did not squash the 'subpoena to appear' (or something like that) that the other side filed.
So, that is different than the judge issuing an order.

Be sure to read his 'comments' on all six pages. He gives a lot of very detailed explanations regarding many points.


Below is one of his comments from page 2

The court will only be ordering Obama to appear once Taitz files, and the court grants, a motion to compel.

To establish ballot eligibility, Obama's lawyer only needs to demonstrate three things: 1) natural born citizen, 2) 35 years old, and 3) 14 years' residence. I'm sure Orly herself will stipulate the third. Obama's lawyer need only submit a certified copy of Obama's birth certificate to prima facie establish the first two, at which point burden of proof will shift back to Orly.

Note that none of this requires Obama to be present. Obama, through his lawyer, will refuse to comply with the subpoena even if it is not quashed, forcing Taitz to file a motion to compel. That motion will be denied because Orly is unable to articulate a clear legal argument for why Obama needs to be present for any of the above.

Once Jablonski drops the birth certificate on the judge's desk, it's al over for Taitz.

Once Jablonski drops the birth certificate on the judge's desk, it's al over for Taitz.

Submitting a *certified* copy of the birth certificate into evidence would end this non-sense post haste. I just hope Jablonski does it.
