Mentally challenged girl, 15, 'gang raped under her desk during class as teacher did NOTHING'

A mentally challenged 15-year-old New York girl endured a brutal gang rape as she was trapped beneath her by two boys with her teacher only feet away, alleges a lawsuit filed Friday.

The special needs student, identified only by the initials K.J., was allegedly sexually assaulted for 10 minutes as another student 'hit her on the head whenever she tried to escape,' during a science class at Martin De Porres Academy in Elmont, N.Y.

The girl's mother, who filed the suit, alleged that the teacher ignored the assault even as one student danced on the desk while another attempted to sodomize K.J.

Though the girl told a school social worker the next day, school officials failed to report the crime.

The name wasn't familiar to me, so I looked I up. It's a vocational school for disturbed NYC kids. On their website is a letter stating that no charges were filed by the police and the teacher was fired. Why was the teacher fired if no charges were filed? Did nothing happen or are the cops covering up a rape (doubtful)? If they are, why? Something about this story doesn't make sense.

Here is the "letter" that's on the website.

You may be aware, a newspaper has recently reported on an alleged incident from May 2012 at a high school run by the Martin De Porres School known formerly as the Martin de Porres Academy for Career Development. This school, which was consolidated with the Martin De Porres High School (Rosedale) moved to the Rockaways in September 2012. We serve special needs teenagers who have serious emotional, psychological, social and behavioral problems, and whose needs have not been met within New York City Department of Education’s special education programs.

We hold our teachers—indeed all our staff—to a high standard. Therefore, as soon as we learned about the allegations, we conducted an internal investigation. As a result of our investigation, the teacher was fired. We also cooperated fully with detectives from Nassau County who advised us that no charges would be filed against the alleged assailants.

Our Martin De Porres community is a family. We have seen your children through some difficult times, and we have watched with pride as they evolve into responsible adults. I want to assure you that their safety and well-being is our top priority.

With tons of press scrutiny and an aggressive female Democratic (by most recent affiliation) attorney general. They couldn't get away with it. I don't understand why they didn't file charges. The Daily Mail says that these kids are already coming from juvenile delinquency. Something doesn't add up.

is why these cases don't go to court. I

n some areas, the ranges of IQ, emotional maturity or behaviors are not separated. Children not prone to violence or acting out because they are working on just being able to function - carrying out a conversation, writing or reading being a huge challenge, reading a clock, knowing how to tie their shoes or those who need care such with tolieting or in wheelchairs, are bullied and abused by those who are much more capable physically and mentall. They are troubled as they come from homes where they are abused and act it on other children unprepared to handle it.

The lesser capable are the perfect victim, unable to express and resist being bullied or attacks, verbal, physical or sexual. Budget cuts, a sense of disrespect and nepotism result in administrations who will squeeze all of them together for the higher payments from their state for disabled education. They are denying them the education the IDEA mandates.

Since this appears to be a private school, there is no basis to force them to obey the mandates as public schools are required to do. But even those can fall down on the job as parents of other children resent the high cost of trying to get them ready to meet society as adutls and funds are cut mercilessly. Yes, things happen.

I try to picture the scene in my head, and it just doesn't add up.

It's not like they were throwing spitballs behind the teacher's back, passing notes, or even fighting in class. They had a girl exposed and were actually raping her openly at her desk while the teacher conducted class. Individuals were having sex, one after another, as others looked on, and no one but the girl said anything during or after the act. It's so unimaginable that I'm casting a weary eye to the story.

Police and school officials have little or nothing to gain by pretending it didn't happen. I'm not buying it, at least not at face value.

On edit:
Why do they say "under her desk"? Why not in the aisle where there's more room? It's not like no one could see or hear it under a school desk. I'm sure a gang rape would be the primary focus of the whole class, no matter one's level of depravity.

they conducted an internal investigation. the cops were also involved and chose not to press charges on this alleged incident. However, it is very plausible that the internal investigation yielded other information that warranted the teacher's firing, either related or unrelated to this incident.

I agree with others here that the news story as given here doesn't make much sense, and if it is from the Daily Mail then I would tend to guess that the story is twisted and incomplete. But that doesn't mean that something horrible didn't happen, just that we can't tell the reality from a Daily Mail story.

Despicable situation, and I have no love for Catholic schools. But I worry when people pick up stories from the Daily Mail, as the OP did. It's a British rag that scans the planet for the most sensationalistic stuff it can find, often without context.

you'd have found that its a re-report from a US paper. As such the fact I found here in the UK in our own Daily Mail becomes incidental.

What context did you need on the subject of rape ?

I'm just not a fan of the Daily Mail and their propensity to pick up months-old articles from other countries and splash photos of scantily-clad celebrities next to them.

I am just adding it for purposes of clarity. I will wait for the court case before drawing more of a conclusion (if even then). Obviously a lawsuit filing only gives the plaintiffs side of the story. The administration thought the teacher did something wrong and fired that person. The police did not charge (which does not mean that something did not happen but maybe it can't be proven). If it dates to May, then probably all criminal investigation is done.

Conservative media has done a great job with these commentors, as most of them are Americans, non-stop slanting of news. And we wonder why the public is buying the story of charter schools for their kids?

Even though private schools in many ways have more problems. My brother went to private school for a year and I never met a more messed up group of kids. A lot of the kids did cocaine and pills, were alcoholics, thieves, and a loud bad group of people. I'm not saying all private schools are bad, but I wish some people would quit thinking public schools are bad and private schools are great, because private schools have plenty of issues themselves. Hmm some people just listen to stereotypes too much.

I've seen them dredge up stories that were years old and the media puts the story on the news as if it is news, which it isn't. The stories will appear as they have the contracts written but need public consent. which means the public money will be going to private hands for profit on what previously was cheaper.

What makes it easy to attack the public institutions is they have to keep records get funding and to meet the laws they operate under. So there it is, for any group to visit, comment on, going through court orders, medical and other reviews, even going to see the people being served.

They loiter like foxes at the henhouse for an opportunity. When they get a legislator in the groove with ALEC on privatization to alleviate public embarrassment over the problems that come with being revenue starved, they push for more money taken and given to their supporters. Until they have a block working daily to undermine the commons and have a presence that cannot be denied in the making of laws and budgets.

The fact that once the warm bodies are moved to the private schools, living arrangements or whatever else they can sell and still make huge profits from. They squeeze it out by paying low wages to unqualified people, in substandard conditions, and not keeping records and not doing the job except while they are being investigated.

This is not something the public will learn by media, who are complicit in this shell game and lay off investigative reporters. When they are investigated by lawyers advocating for individuals being abused or denied not only IDEA, or protections form other laws passed by liberals, they claim their information is propriety or stonewall until the problem goes away, by sending their wards to the prison, the cemetary or by the parents negotiating another place for disabled to be educated or live, if that is the case.

It all results in great stress and choas in the lives of these folks and is the recipe for community failure and tribalism.

Im not suprised that there wont be any charges filed. Doesnt matter if they lived in the most liberal county in the most liberal state, in the most liberal country. Special needs children have been and always will be 5th class citizens. Dont even get me started, it makes me sick.

Lawyers can basically fabricate charges because schools NEVER go to trial, and therefore the lawyers are never held accountable by judges for filing frivolous actions.

If you have a lawyer unscrupulous enough to file an insurance claim, which is what this is, you are in business.

Did she go to the hospital that day for a rape exam?

A lawsuit is the first time this becomes public knowledge? Kids would've been talking about this throughout the school, to parents, to other teachers.

Something smells. Not saying it's definitely not true, but my initial reaction is that there's more to this story.

Besides, I see you allowed only the boys to be armed in your scenario. I'd imagine if the girl was sitting there with a .38 special, this wouldn't have happened quite this way, but that's still a completely senseless point, sarcasm or not. Indeed, if the boys had guns, they probably would have been playing with them and left the girl alone. Now there's some sarcasm.

reported it, including the "dirty money" he would leave in her locker afterwards. She was already being treated by a psychiatrist, psychologist, hospital and had told them all, even the school nurse and Principal. No one believed her and no investigation. She was told not to lie about it anymore. She was 12 years old. A YEAR LATER, she ends up pregnant with the janitors child an they aborted the fetus.
Her special gift that made her a savant was that she could remembr everything that ever happened to her in complete detail, including dates and times. I watched her give an 8 hour deposition where she correctly gave the admission and discharge dates of every hospitalization of her life, including the day of the week. The janitor was subsequently convicted, and the so called, medical providers and the school district settled. She. needed some of those Sandy Hook teachers and administrators in her corner. I hope she is ok now. MHMR of Texas could not handle her by age of 16. She was incredible strong and at one point beat up 5 cops and her 6'3" mentally challenged husband. The "voices in her head" told her to do it. Her deposition would have gone longer but the defense attorneys started to attack her. During a break we learned the voices were telling her to kill them. I stopped the deposition, and when the defense complained, I told them that I would not be responsible for what would happen if they continued. After hearing why I stopped it, they quickly agreed. She was turned into a monster by this and the system had let her down. Needless to say, the deposition was never rescheduled and the parties settled. No telling how different things would have been for her and her absolutely complete recall of all events of her life. They were amazed that she was NEVER WRONG about a single date or event. Hard to blame her memory and graphic recollection of he abuse she suffered. When asked why she never reported her biological fathers rape before she and her brother were taken away from her parents due to abuse, she said that she had not learned to speak yet, she was 2 years old. When need to protect our children from abusers and take rape seriously. The janitor was 57 years old!

Yes, these minds get broken, people turn dangerous, their lives forever changed and it's not seen in public.

School officials HAVE to report any notice of this. The lawsuit is bogus, a nuisance suit designed to get money.

Of course the school did it. When there is money to be made, truth goes out the window.

Generally such lawsuits do not yield much money. That money goes into the hands of the attorneys and the victim sees nothing but some expenses. The purpose of the lawsuit is to change practices that are hurting people. to force preventative measures to make sure it doesn't happen again. There has to be a pattern of bad behavior by the defendant to get to court.

Perhaps in his world there is an insurance company, usually for private businesses. Public schools pay judgements out of the state treasury, and will muster its corral of attorneys to defend against it, right or wrong, to protect the treasury.

I've seen cases where a state AG begged the legislature to change their practices in regards to the vulnerable to stop having them defend what the AG said was wrong and illegal, but they had to defend.

Many entities are self-insured, it makes no sense to go through a middle man, that is, an insurance company. What is reported in the news is but the tip of the iceberg in such situations, to warn the defendant what is coming their way.

All the details are not put in the media. The world is not what RW media says it is.

It's still there, but only the newest show. A guy in the UK said it was good she was mentally deficient or some such term, because she didn't know what happened or whatever.

An IQ of 60 is not brain dead, as some may imagine; neither is an IQ that is half of that. Yes, she knew it, she felt it, she didn't want it, she remembered it, she was terrified and tried to defend herself. She was aware!

Any excuse to minimize the crime, drunk, stupid, etc. Rape culture wins again.

Anything to shame that school and the NYDOE to pay up a big settlement.

What's worse than the allegations made by a lawyer are the comments following the piece, which seem not to understand what a CIVIL claim is.

Anything goes in a civil claim designed to get a pre-trial settlement. Any lawyer can make up or exaggerate something knowing he or she will never be held accountable by the bar or by the judge assigned to the case.

If there had been criminal charges, that would be one thing, but this is a civil suit to collect insurance money.

Our civil court system is broken.

which means that there was likely not proof beyond a reasonable doubt.

A teacher was fired after an investigation, so "something" likely did happen.

Since all the children in the class were developmentally disabled, it is possible that charges were not filed due to that fact.

There is a lot we don't know. Yes, this is a civil suite to collect money. But we certainly don't have enough information in this case to say "Our civil court system is broken." The civil suit may or may not be without merit.

It's not anything close to the criteria that police use to arrest or prosecutors use to charge. Since rape cases are a matter of consent, absent witnesses, video footage or obvious injuries that couldn't be construed to have been consented to most rape cases boil down to a matter of he said/she said none of which would ever get to court if police and prosecutors relied on any proof beyond a reasonable doubt in order to either arrest or charge.

Seeing as there are no charges of any kind against anyone, I simply don't believe the allegations in the suit. This mother found out about this and kept the child in the school with her alleged rapists while she continued to be bullied, harassed and even physically assaulted all the while with teachers and administrators ignoring it? Baloney.

What is your experience with dealing with special needs children. I keep hearing you say a nuisance suit. My son is a special needs child, I have seen the discrimination abuse, and neglect firsthand from teachers to doctors.

...it's doubtful the alleged rape took place under any of those desks nor could a 15 year old dance on one of them.

The office should have been called ASAP, and 911. The teacher couldn't restrain several boys, so there raelly was no way for tehm to physically protect the girl.

A mentally challenged girl was raped by two classmates during science class at Martin De Porres Academy in Elmont, N.Y., the New York Daily News reports.

A lawsuit filed Friday claims that the 15-year-old girl, identified by the initials K.J., was forced to perform oral sex on two teenage boys under her desk for 10 minutes.

A third boy is said to have "hit her on the head whenever she tried to escape." The assailants also tried to anally sodomize the special needs student, according to the lawsuit.

The girl has an IQ score below 60, was sent to the school by the city, and was the only female in a class of 14. The attackers were reportedly residents of Casa De La Salle, a home for juvenile delinquents.

Thanks for posting the story, dipsydoodle. Looks as if the other US sources were a little slow on this story, but at least the New York Daily News and the Huffington Post tried.

Horrific ordeal that child had to endure alone at the hands of monstrous cretins.

It's a miracle anyone knows about it at all, beyond the victem, her family, the teacher, and the stufents.

I'm sure the school people hoped they had buried it sufficiently.

That's another benefit our right-wing can count on: if their spawn attack people in a private school, there's a better chance no one will know! Add that feature to the fact private schools don't have to live up to any standards set for public schools.

With an IQ of 60, just how much of a criminal mastermind was she?

Did she deserve to be in a class with delinquent children, or should she be in a foster home or another facility that can cater to her special needs. I doubt she dreamed up ways to break the law and needed reform.
