That could be. However, any attack with a deadly weapon should be considered attempted murder, should it not?

Gunshots are fatal something like 5% of the time; it can be difficult to argue intent for attempted murder.

It may be that those silly states see a distinction... and that perhaps the sentencing range for one should be different than for the other.
