This week the Supreme Court will hear arguments about equal rights for gay Americans. But we already know what Scalia thinks.

During oral arguments in Lawrence, the attorney challenging the Texas law argued that it was "fundamentally illogical" for straight people to be able to have non-procreative sex without being harassed by the state while same-sex couples did not have the right to be "free from a law that says you can't have any sexual intimacy at all." But Scalia pointed out that gays and lesbians could just have sex with people of the opposite sex instead. "It doesn't say you can't have—you can't have any sexual intimacy. It says you cannot have sexual intimacy with a person of the same sex." Later on in his dissent, Scalia argued that Americans' constitutional right to equal protection under the law wasn't violated by the Texas law for that reason. "Men and women, heterosexuals and homosexuals, are all subject to (Texas') prohibition of deviate sexual intercourse with someone of the same sex." That should sound familiar: It's the same argument defenders of bans on interracial marriage used to make, arguing that the bans were constitutional because they affected whites and blacks equally.

Scalia has been on a tear lately, calling the Voting Rights Act a "racial entitlement" and ripping into the president in a dissent on Arizona's harsh anti-immigration law in the middle of an election season. But when it comes to LGBT rights, he's been off the rails for a long time

and how unfair it is of him to suggest that some of us don't have the right to sexual expression just because he finds it icky.

What rigid, narrow, morally certain men like Scalia never realize is that hetero sex seems just as icky to gays. Telling them to go against their basic natures in that department is always going to be doomed to failure.

I wouldn't be surprised if Scalia supported lowering the age of consent to 12 to keep Ted Nugent, Rush Limbaugh and the other right wing pedophiles from being punished for their evil. Scalia has revealed his hatred for America on many ocassions- this is another instance of Teabaggers targeting America for liberty destruction and the unravelling of American cohesion.
Why do Teabaggers hate America? Why does Scalia hate America? Why do fox "news" viewers hate America? Why do NRA gun-fetish advocates hate America?
They hate the liberties and social saftey net that allows Americans to speak the truth to right wing power structures and have a voice about labor, drug, immigration and environmental policy. The strong America created by the new deal and other progressive policies is roundly hated by right wing extremists like Scalia, Glenn Beck and LaPierre. This is the reason right wing teabagger legislators and Scalia are working so hard to destroy our dearly held principles of freedom and equality. I just wish these people that hate America so much would move to a country they like, instead of ruining OUR country.

One thing that gets me is that so many objections are based on physical procreation and biological construction.

Not long ago I was listening to an interview about a man who may or may not have "been gay" - the question was about emotional attachment and lifelong partnership with a person of the same sex, but the answer was "he couldn't possibly have been gay", as there was no evidence at all of gay sex having occurred...some people just don't get it, in the most boneheaded obvious way.

It makes one wonder whether some people are capable of feeling or perceiving love, and so can't imagine that its of any importance to others.

... in the not-so-dumb world, I heard a story on NPR about parents protecting kids from inappropriate TV. And the family they featured comprised of two fathers and their kids. The gay aspect didn't even come up as an issue in the story, not at all whatsoever, just a mention of how the child's "dads" safeguard their family's TV consumption. This was as clear a sign as any that this is being accepted as a normal situation. Couldn't help but raise a fist in my car on the way to work.

Why would uptight religious conservatives want gays and lesbians to have sex with heterosexuals? I thought they just wanted heterosexuals to have sex.If gays and lesbians can't marry how does one know if they are in a relationship and not open to a new relationship that might be hetersosexual?

The Justice who argued that the Paula Jones civil case should go forward because it wouldn't take more of the president's time than what it took for him to play a round of golf. Five years, $70M of taxpayer's money, a president & first lady left with a $2.5M legal debt, staffers left with a combined $14M debt and what did we get for it? A special prosecutor who used as evidence an illegally recorded audio tape to entrap the president over a fling between two consenting adults.

Constitutional rights, but actually yes Many of us have at some point in our lives attempted to make ourselves believe we could be straight, and done everything we could to try to make it happen, including abstaining from sex, or even trying to force ourselves to have sex with opposite sex partners that we had no sexual interest in what so ever.

what does MORALITY (and who gets to decide WHOSE morals?) have to do with the constitutionality of your sexual desire for a man or a woman?

I could no more "make" myself desire to have sex with a woman than a lesbian would want to have sex with my husband.

I guess he has never had true sex.

Sex = the act between two people for sexual gratification.

How can people have sexual gratification with someone they don't want to have sex with Tony? You are a really stupid little man.

present day Robert Taney. He doesn't belong on the Supreme Court. He is mixing his personal and religious beliefs with the Constitution. It is true some states enforced laws against interracial marriages and even having sex out of wedlock was deviant. He belongs back in the time of the Salem witch hunts.

Still, I'm glad to see him voluntarily both condemning his soul to hell and enshrining his historical legacy as one of the worst, most prejudiced judges to ever sit on the SCOTUS. Right up there with Justice Taney leading the way on Dredd Scott and Justice Brown on Plessy v. Ferguson, to be judged harshly for eternity.

Equal rights to marry someone of the opposite sex. A gay person is free to marry someone of the opposite sex. They could not be clearer in saying they are not listening at all and not considering other people's point of view.

They are so mean and little. They don't even think of the straight people who may have been married to gays trying to do the conventional thing in the past. So they are putting potential suffering onto some straight people, too. They want to go back to the 50s where

The reason why the Gays and Lesbians want to have sex with the same gender is because they are configured for sex with the same gender, just like we are for opposite gender and Bis are set up for both genders.
It's like trying to force an American plug into an Australian socket.

Despite numerous attempts to awaken the citizens as to their intent on imposing their religious sanctions on the entirety of society, they continue to be able to operate unopposed in virtual secrecy. This cult has taken over the Catholic Church hierarchy blocking any attempts at meaningful reform with their determination to return it to the mentality of the Dark Ages. The cult is so misogynistic that their multi-million dollar headquarters in New York City has separate parking and entrances for males and females. Women in the cult are relegated to performing menial tasks and regarded as inferior beings by their male superiors.
