She might be wise to contact any local Occupy folks..they have been very effective in blocking banks from taking people's homes.

I saw it mentioned that they weren't going to pay her 'retail' (even though they should be embarrassed enough to do that) but wondering if they offered her something.

XYZ Auction House: Sure, we will be there right away.

Barnett: Hey XYZ Auction House, we made a little faux pas, do you still have the stuff?

XYZ Auction House: Hey Barnett, thanks for the job, we made a quick turnover and a tidy little profit off the goods. No we do not have anything left. Have any more jobs let us know, great doing business with you.

Barnett: LOL, guess we will make an offer that they can not refuse, we will be in touch for future jobs.

Katie Barnett is the victim here. She is the one who had her stuff stolen (and probably auctioned off) by the bank.

At first I thought you were just just mistaken about which party was which - when you wrote your post about Barnett calling up the auction house to have the stuff auctioned off...

I tried to point out that Barnett is the victim - she isn't the one who stole the items from the house and (most likely) had then auctioned off.

But your new response has me totally confused. Would you mind explaining what point you are tryjng to make?

I understand your confusion, I am to old and have lived through to many name changes in banks. Barnett was a bank in Florida, from years ago. I assumed that they were involved, I was wrong. I am with the person (victim) on this issue, believe me, it was a mistake on my part. My humble apologies!

They were not even willing to settle for giving her just $18k for her stuff. It doesn't say if they even came back with a counter offer or just said no.

No one from the bank would go on camera with 10TV about the incident. The bank president told 10TV News that the bank is trying to come to terms with Barnett.

Terms? The only terms they should be coming to are "We're very sorry we made this mistake" and "Here is the $18,000 plus extra for the problems and distress we have caused you" and "Again, we are very sorry".

Re: the bank president, what kind of person could know that their organization fucked up and still refuse to make it right?

It is this stuff that makes me worry that I'm handicapping my children by raising them to be decent, honest people.

How did they get into her house? If they BROKE IN AND TOOK STUFF that's breaking and entering and burglary. Charge them.

According to the fifth amendment no person can be denied their property except by due process nor shall property be taken without just compensation.

Oh wait.

That's if the GOVERNMENT takes it and uses it for the public.

I guess it's fine if a corporation takes it and doesn't pay back a dime.

Right?

Everyone involved in this "mistake" should face criminal prosecution for breaking and entering, burglary, and grand larceny at the very least.

It's because the banks hire these repossession businesses to do this work. And then when a mistake is made, it ends up being a bunch of finger-pointing.

But a lot of these crews they hire are incompetent.

This is not an isolated incident. Banks are doing this all over our country and have been for several years. Makes me want to puke.

She needs a good lawyer and a writ of mandamus if the could figure out a way to weasel around the issue. Maybe initiate a lawsuit and the go to the court with the writ? Then sue the shit out of them?

I'd start with Trespassing, I.I.E.D.. and theft and/or fraud.

Not sure it would work but I'd be down at the Courthouse so often they'd give me an office of my own.

Remember, since the bush years, there is really no such thing as precedent. New rules are made and old ones broken every day. We need to start playing hardball just like they do.

Who knows anymore?
