Florida governor says he'll sue Georgia for water

APALACHICOLA, Fla. — Florida will fire the next salvo in its water war with Georgia next month as the governor promised to seek a Supreme Court injunction for more river flow into the Sunshine State.

After members of Florida's congressional delegation had a field hearing here Tuesday to address the oyster crisis in Apalachicola Bay, Gov. Rick Scott announced his intention to file suit, continuing decades of litigation, failed negotiations and acrimonious claims over the amount of water that Georgia allows to flow into the Apalachicola River.

"We've been trying to settle this for 20 years with Georgia," Scott said while eating half-shell oysters on a dock along the troubled river's shore. "We haven't had any success doing it so Florida's going to file action."

The 112-mile river begins at the Georgia-Florida state line with the confluence of the 344-mile-long Flint and 430-mile-long Chattahoochee rivers. But what happens upstream has become a bane to the seafood industry here that relies on a mixture of river water and salt water to nourish the oysters in Apalachicola Bay.

It's known as the 11th Amendment, which bans suits against states from out-of-staters.
