LOL whatever that means

I think it's if your share is more than 9.5 or 10% of income
and/or the plan pays less than 60% for services

There is also grandfathering but if that doesn't apply to your group then I would suspect your next plan will be at least minimally exchange compliant because your employer is very unlikely to offer any plan if it still results in the penalty (of course they just got an extension on that piece so who knows how that will work in reality at all), so I guess they could stick you another year. I don't know who that extension affects the escape hatch. Lots of balls in the air at the margins in a program designed to impact the margins.
