North Dakota Says Man In Same-Sex Marriage Can Also Marry A Woman

(Reuters) - A man already married to another man in a state that permits same-sex marriage could wed a woman in North Dakota without breaking state laws, the state's top attorney has found.

The finding raises potentially complex issues about Social Security and death benefits, tax exemptions and even possible prosecutions for bigamy or polygamy, said a constitutional law expert.

Those issues are likely to arise more often with 16 states plus the District of Columbia now recognizing same-sex marriage while a majority of states still ban it, said Jeffrey Shaman, a professor at DePaul University's College of Law.

The state attorney general's opinion came a day before a U.S. federal judge struck down a portion of Utah's bigamy law governing cohabitation as unconstitutional, saying it bars consenting adults from living together and criminalizes their intimate sexual relationships.

2. No, I don't think so. But a woman could marry both a man and a woman in different states.

In Utah a woman could marry one man and cohabit with any number of men.

3. Will ND permit daisy-chaining, e.g., M-F-M-F-M-F etc. What if an internal member broke completely

and link a chain to form a ring...and it would be a valid plural marriage until either state or federal law explicitly struck it down.

then move to ND and marry a man who is also in a same sex marriage entered into outside the state of ND.

My gosh, that would be a clusterfuck.

can't get a divorce in a state that doesn't recognize gay marriage. Now, a gay man can't remarry a gay man in N Dakota because gay marriage is illegal (which is what's causing the problem to begin with) but....could that man marry a woman? It's not polygamy because the first marriage isn't recognized. If this individual were to move back to a state like say California where both marriages would be recognized there would be an issue.
I think the phone call and subsequent story sounds a bit like a set up. Maybe this guy that called and didn't leave any information was serious, but it's highly suspect. The right wingers are now spouting the meme that legalizing gay marriage now leads to polygamy.
