Daytona-area brothers to appeal denial of stand-your-ground defense


DELAND — Two brothers will appeal a judge’s denial of their stand your ground defense in the killing of one man in a barrage of bullets and the machete slashing of another.

Circuit Judge Margaret Hudson last month denied brothers Ray and Wayne Greenlaw’s stand-your-ground defense to the charges of first-degree murder in the killing of Brian Leverett, 41, on Oct. 29, 2011 near Daytona Beach. Each brother is also charged with attempted murder in the slashing of Leverett’s friend, Justin Riley.

Hudson said during a hearing on Tuesday that she would not set a trial date for the brothers while their appeals are considered by the 5th District Court of Appeal in Daytona Beach.
