Dunn Jury: Some questions are a sign of idiocy...

I just read that the jury has been asking whether or not the right to self defense applies to a group or individual. They also asked if each count required the reevaluation of the self defense argument.

These are stupid questions. Hypothetically, if you're being confronted by a man with a shotgun and his friend is standing next to him, you can't shoot the friend because of said shotgun.

This worries me. At least one person on the jury is probably a moron.

have been used by any or all of the 4 boys in the SUV. That's why Dunn kept referring to 4 shooters

Assume for a minute there was a shotgun (I'm 100% SURE THERE WASN'T ANY SHOTGUN IN THAT SUV)

I couldn't see a person being charged, or convicted, for shooting at the SUV. I figure if you are going to roll with someone brandishing a shotgun, you takes your chances.

Can you be charged with attempted murder of the person sitting behind the person with a gun in a vehicle?

Anyway. I'm afraid we are discussing this because one or more nit-wits on the jury are giving some credence to the shotgun story.

If they let him off on the murder charge but convict him of attempted on the other kids I don't know how I'll feel. On one hand, it would be better than nothing. On the other hand, it will lend credence to the theory that juries are comprised of people too stupid to get out of jury duty.

(for the record: I think jury duty is not something you should get out of. My public defender friends cringe when they here liberal friends talk about getting out of jury duty. They are tired of dealing with law and order republicans who show up).

What you're essentially arguing is guilt by association.

If a gun is pointed out the window of a car you should first attempt to flee. If that is not an option and it is not fairly clear who is holding the weapon, and you have a firearm, you should aim for the weapon as it will be closest to the would-be shooter. It is not okay to simply open fire indiscriminately into the side of a car.

These jury questions are stupid.

so if you see a shotgun you can stand your ground, perceive a deadly threat, and proceed to shoot. If you kill anyone its all ok because syg is a really stupid law.

My hypothetical has a shotgun - no doubt about it. How do you charge with attempted murder based on the person sitting BEHIND the guy with the shotgun? Shouldn't it only be 2 counts of attempted murder?

Or 30 inches in front of the person with the shotgun?

Since he's obviously carrying, and if the wrong person is carrying a gun,that's enough.
