Angela Corey: We Are Retrying Michael Dunn For 1st-Degree Murder

During a press conference following Michael Dunn‘s murder trial, Florida state special prosecutor Angela Corey said he will be retried for the murder of 17-year-old Jordan Davis.

“We intend to fully push for a new trial….Justice for Jordan Davis is as important as it is for any victim,” said Corey.

As previously reported by NewsOne, Dunn, 47, has been found guilty of 3 counts of attempted second degree murder and one count of hurling a deadly missile. A mistrial was declared on the first-degree murder charge in the shooting death of 17-year old Jordan Davis.

The jury deliberated for four days and remained deadlocked on the 1st-degree murder charge and lesser charges, including second degree murder, manslaughter, justifiable homicide, or excusable homicide.

he had better hope he does not have a black cellmate. I am sure all the inmates are aware of the Trayvon Martin shooting. He may not live long enough to serve out his sentence, plus if he does, he will be about 107 years old.

Of course, if he's Jewish, then he really out of luck.

That is why the jury hung, most likely.
Make it easy for the jury, take the degrees out of the deliberations.

Casey Anthony is a good example. Not having a plan, being very disorganized against these unethical defense lawyers, and not being clear for a jury to decide. I have read plenty of lawyers who say cop shows have led jurors to believe that beyond a reasonable doubt means beyond any doubt which is impossible to prove. They are also think trials should have CSI-style evidence and that's just not the case. The prosecutors need to get a whole lot better in presenting their cases. Thankfully they have another chance rather than an acquittal on the murder charge.

Personally, I don't see first-degree anyway, but of course IANAL and don't know the nuances of law, especially Florida law. But as much as Dunn seems like a scummy p.o.s. asswipe who killed a kid for no good reason, I don't see premeditation there. Dunn got pissed off and killed someone. I always thought "heat of the moment" was second degree, not first degree. So, that might be where some of the jurors are coming from. And even if that understanding is technically incorrect, it could make it really hard to get a unanimous conviction for 1st degree.

That said, if it was only between 1st vs. 2nd degree, unless you had someone absolutely insisting that it couldn't be less than 1st degree, they would have agreed to second degree and saved the state a lot of money for a second trial. Or, there was at least one juror who actually believed Dunn was justified and wouldn't convict him on anything. It's the latter case that I suspect, and I don't know if a new trial will even help.

I sure wish we could see the vote tallies from the jury.
