Hung jury in Rite Aid deadly shooting trial

NORFOLK, Va. (WAVY) – A Norfolk jury couldn’t reach a verdict in the case of a deadly shooting inside a local Rite Aid.

The jury was trying to decide whether or not Bernell Benn was guilty of voluntary manslaughter for the shooting death of 42-year-old Ramon Colorado inside the drug store at Tidewater Drive and Cromwell Road in August 2012.

Benn claimed self-defense. Both men had guns.

After continuing deliberations, the jury came back and said they couldn’t come to a consensus. A new court date has not been set.

2. To answer my own question: Yes, the guy who started it ended up dead.

He was talking on his cell phone and was walking around and it wasn't at all clear that he was waiting in line to be served - if anything it looked as if he was waiting on a prescription he had already ordered. Having said that, the polite thing for the guy in the shorts to have done - and what most people would have done, imo, would have been to say, "sorry, I didn't realize you were in line - go ahead." Getting into a fight over one place in line at the drugstore is just stupid. It seems that a perfect storm was created by two hot heads with guns - a good argument against allowing people to carry guns all over the place. And also a good argument against the idea that having a gun will keep you from getting killed - particularly if having that gun makes it more likely you will be stupidly aggressive.

but Colorado was foaming at the mouth crazy. To pursue the other guy with pepper spray over a verbal confrontation. Benn claims that Colorado drew first as well.

In a normal situation Colorado should have said I didn't realize you where in line - go ahead or Benn should just realized that wondering around the store is going to make other customers think he is not in line.

It is just as stupid as the cell phone confrontation maybe more so. What are a few minutes in line for God's sake.

So much was unsaid and could not be admitted to this trial. The video shows the start of the fight with the mace. Then it skips to the chase. This is where this video has been altered for the public. The jury however seen the full video. I am lucky to be in the family of one of the jurors. Im going to tell you what they told me.
From the start, the argument was about who was in line first. Then Mr colorado maces Mr. burnell. Mr Burnell starts to walk up the far right isle heading toward the front of the store. Mr colorado then goes around up the middle isle and cuts Mr burnell off talking to him. Mr burnell say's Mr colorado is saying he has something else for him. At this point Mr Burnell says he see Mr colorado with a gun and he pulls his gun. Mr burnells goes up the middle isle with his gun and confronts Mr colorado who now sees that Ben is armed. We then see Mr colorado then runinng with ben after him both firing shots. Both guns were discharged. This is the kicker the store video is still running. Mr Colorado is not dead. The pharmacy employees did not call the police and stated they were afraid. Eventually one of the store employees called the police. When the police arrived no one attended mr colorado. They walked around him. Finally a female officer checked on his status. He sat on the floor of that store for some time and did not get any assistance until the ambulance arrived its this time lapse which could have caused him to die. (the store had six cameras all of them had the same view of the store....go figure that one out).
We know Mr. colorado was fired from both law enforcement positions. Mr colorado was told he could not carry a fire arm. We know mr colorado had bi polar mental disorder (that is what he was in line to pick up). We know mr colorado had used violence threats to public officals and has restraining orders on file for him. All of the above was not admitted to Mr burnells case. Burnell has a record of disorderly conduct and traffic tickets. The Jury came back hung for this reason. The testimony provided by the prosecutors were false. The jury stated that most of testimony provided against Mr burnell was false. They had access to the entire footage and what was said did not match what was on film. the result the first time was 7 (not guil) to 5 (guilt) manslaughter. But it has to be all or none. By the time it was closing it 11 guilty 1 not guilty, why because people wanted to go home for the trial was all day 3 days. Now you know more than what was in the news. After this story we really need to look at race and trials because it plays a big factor in outcomes. Burnell may be a jerk but does that give people the right to mace people and then stalk them. This is the prosecution opinion - the prosecutors claims Benn did not need to kill Colorado in order to save his own life.
You are being maced by stalked by someone you do not know would you not fear for your life. I said stalked because mr colorado is closes to the door and did not leave what else was he still there for even from the footage he still at the top of the isle waiting for burnell..... Are AA males suppose to be immune to fear when their attacker is white.
