Same-sex couple files for divorce in Alabama

MADISON COUNTY, AL (WAFF) -

A same-sex couple, married in another state, has filed for divorce in Madison County. However, Alabama does not recognize same-sex marriages from any state.

A court filing states the women married in Iowa in 2012, and the couple since moved to North Alabama.

The court system shows the case is assigned to Madison County Presiding Judge Karen Hall. Judge Hall has not signed off on the divorce or set any hearing dates.

I wonder if the couple is trying to handle this themselves?

Seems as though an Alabama attorney would have told them not to bother.

the couple is doing this in Alabama to set a precedent for other same sex marriages. That if you can get a divorce in the state, then you should be able to be married in the state.

But it can't get very far along in the process if no relief of the kind sought exists under Alabama law.

It's as though two people who aren't married at all are trying to get a divorce.
