Suspect in Austin SXSW fatal car crash facing death penalty

I don't get that. I'm anti dp no matter what, but how is this even capitol murder? Also, I can't help but think of that rich kid who got off completely after killing 4 while driving drunk. One good reason to oppose the dp is how fucking unequal it is. And yes, this person committed a terrible crime.

even intentional vehicular homicide...Wasn't that wealthy socialite who "accidentally" ran over her bed-hopping husband with an SUV (repeatedly) a Texas case also? She sure didn't get the DP...

Prosecutor is out of his/her goddamned mind or just isn't seeing this case straight...

And we haven't even gotten into that "affluenza" entitled brat punk piece of lowlife shit...

5. This guy needs to be locked up for a long time, but it is a messed up that he may be put to death

but that little punk got off because he was rich. Very wrong. Both should be locked up. The kid might get a bit less due to his age, but still not out roaming free.

It's very capricious and seemingly arbitrary. I have never understood that aspect of the death penalty.

And that's leaving aside the million other problems with it including often inadequate evidence and tampering as well as other inequities. Everyone brings up racial stats, but what's telling is that you're much more likely to be put to death (regardless of your race), if you killed a white person, over a person of color.

Gabrielle Jane Nestande has been indicted on more serious felonies related to a hit-and-run that could send the daughter of a powerful Newport Beach Republican to a Texas prison for 20 years.

The 25-year-old former Austin Capitol staffer and Gov. Rick Perry campaign worker, who had faced a single count of failing to stop and render aid to a pedestrian, is now fighting manslaughter and intoxication manslaughter charges.

And this bombshell just dropped, as reported by the Austin Statesman: The prosecution will rely at trial on the testimony of Francesca Nestande, a University of Southern California and another child of Bruce Nestande, a former Orange County supervisor and state assemblyman. Francesca's testimony "is important and necessary in that she can testify to incriminating statements made by the defendant in the hours following the commission of the crime," the prosecution writes in court papers reviewed by the Statesman.

Prosecutors have also seized evidence from two Austin area bars the night before May 27, 2011, when 30-year-old nanny Courtney Paige Griffin was mowed down near her suburban home. Nestande was arrested hours later after an anonymous 9-1-1 caller spotted her black BMW 3 Series sedan with a broken windshield parked in a driveway a half-mile from where Griffin's body was found.

Nestande Gets Probation For Hit And Run Conviction

Gabrielle Nestande was sentenced to 10 years in prison Friday afternoon for the 2011 hit and run death of Courtney Griffin, but the jury recommended the prison sentence be suspended and serve 10 years of probation instead. She also received a $10,000 fine.

Nestande, 25, was convicted of criminally negligent homicide Thursday for Griffin's death. Nestande hit and killed Griffin as Griffin was walking on Exposition Boulevard. Nestande left the scene of the crash.

During the closing arguments for the sentencing phase Assistant District Attorney Mary Farrington told the jury probation for Nestande is not appropriate. She warned the jury that probation would be lax if Nestande serves it in her home state of California. Then Farrington told the jury that prison time for Nestande would provide both a punishment and a deterrent for others.
