LINCOLN The Nebraska Supreme Court has upheld a Fremont woman's right to sue her doctor's office for allegedly disclosing her HIV diagnosis publicly.
The woman, identified in the court's opinion as C.E., alleges that an employee of Prairie Fields Family Medicine in Fremont told a friend about the 2010 diagnosis, and the information quickly spread to others in the community. Sue sued the practice for invasion of privacy and emotional distress.
Dodge County District Judge Geoffrey Hall granted a motion for summary judgment in favor of the medical practice, ruling that the woman failed to raise a genuine issue of material fact that someone at the practice improperly disclosed her medical information.
