Broward and Palm Beach County voters can rest easy. Elections supervisors in the two counties say they wont implement the restroom ban imposed by Miami-Dade County.
In the states most populous county, voters who need to go while waiting to vote arent allowed to do so.
The media office at the Miami-Dade County Elections Department didnt respond to a request for information about the rule. But its detailed by county officials in email exchanges with a disability rights lawyer.
Its absolutely stunning, said Marc Dubin director of advocacy for the Center for Independent Living of South Florida, which serves people with disabilities in Miami-Dade County. Hes a former senior trial attorney in the Civil Rights Division of the U.S. Department of Justice, where he was responsible for ADA enforcement.
It is a current policy of the Department of Elections. Its in effect right now, Dubin said.
It is not a policy in the states second- and third-most populous counties, said Broward Supervisor of Elections Brenda Snipes and Palm Beach County Supervisor of Elections Susan Bucher. Anybody whos at that site is able to come in and use the bathroom, Bucher said.

(58,647 posts)We have vote by mail here in WA and it's great. We have some of the highest voter response, along with OR because they do it too, in the nation.
It should be a national standard if they won't change election day to a non-working day.

(5,455 posts)Because public polling is held at both public and private facilities, there is nothing that guarantees that the private facility has handicap accessible bathrooms. Since the county can not force the private facilities to upgrade their bathrooms, allowing the public to vote in a private facility AND use the bathrooms would be discrimination against the handicapped and the county would be open to lawsuits for discrimination.
The whole situation is stupid and shows a complete lack of common sense, but under the letter of the law, I see why the county made the decision it did.
