A federal judge has ruled that Idaho's ban on same-sex marriage is unconstitutional.
The ruling, handed down by U.S. Magistrate Judge Candy Dale on Tuesday, followed oral arguments on May 5.
Earlier Tuesday, Idaho Gov. Butch Otter (R) filed a preemptive motion asking for an immediate stay if Dale did rule against the gay marriage ban.
In the event of an adverse order, Gov. Otter will timely and duly appeal it to the Ninth Circuit Court of Appeals, the governors motion reads, according to the Spokesman-Review.

(23,156 posts)As a boringly straight person, albeit with various gay friends, I just don't get any of the arguments against gay marriage. Even the supposedly most fundamental one, that marriage between a man and a woman ensures reproduction. As someone who had two kids herself, I think that's all quite nice, but forbidding men to marry men or women to marry women isn't going to miraculously result in those persons marrying opposite gender and happily reproducing.
And that's totally aside from the fact that there really are two many people on this planet to begin with.
Now if all of these courts would just strike down all of the abortion restrictions as quickly, we'd be living in a much better place.
