Washington State Supreme Court imposes limits on vehicle searches

The Washington Supreme Court has limited the ability of police to search someone's car after they've been taken into custody, further extending a long tradition of affording state residents more privacy protections than are guaranteed under the Fourth Amendment of the U.S. Constitution.

The ruling overturns the convictions of two men in unrelated cases who were stopped by police, after which officers found drugs during searches of their cars.

The justices, in an 8-1 vote on Thursday, held that police must obtain a warrant to search an arrested driver's car even if they believe it contains evidence of the crime for which the person was taken into custody.

The ruling extends protections not afforded under a 2009 U.S. Supreme Court decision in an Arizona case that found searches in such cases permissible under the Fourth Amendment.

how does this ruling in Washington state jibe with that?

2. People seem to have a misunderstanding of what was ruled upon.

Strip searches of anyone sent to jail no matter what the offense.. Sent to jail, not just arrested.. If you get sent to jail you will be strip searched and it has been that way forever....Nothing has changed other than the Exteme Court has ruled that policy is justified and legal..

The plaintiff in the strip-search case was arrested after a routine traffic stop and jailed for a minor outstanding warrant that may well have been a mistake. Before entering the jail, he was forced to strip, lift his genitals, squat and cough. If that isn’t an assault on human dignity, you might think, what is?

4. How is this any different than ANY Person going to jail?

Every single person entering jail is stripped searched..It has been that way forever.....

5. oh really? when was the last time you were in jail and were strip searched?

I had the pleasure of being rounded up as a protester and thrown in jail for the night. Never once was I STRIP SEARCHED.

So, strip searching is just fine with you, I take.
