The court rulings Tuesday involve only two of many pending cases challenging the Affordable Care Act or administration rules implementing the law. One estimate puts the total number of pending cases at more than 100.
Two cases similar to the two ruled on Tuesday were filed in federal district courts in Oklahoma and Indiana and are working through their circuits. The four cases all challenge the use of subsidies in federally run exchanges. If ultimately successful, such a challenge would undermine the Affordable Care Acts central goals of getting more uninsured people covered and keeping it more affordable by ensuring young, healthy people are among the insured.
A previous ruling paved the way for a dispute over subsidies in state and federal exchanges: NFIB v. Sibelius made the expansion of Medicaid voluntary for the states. The subsidies being challenged affect the 36 states that opted out of providing their own exchanges, including Nebraska, and chose federal-state partnerships, like Iowa.
