"Brown was hit by one bullet, then—as Brown pleaded for his life — Wilson fired “five or six” more"

Last edited Mon Aug 18, 2014, 09:29 AM - Edit history (4)

The fact that more than 400 black men and boys have been killed by white cops every year in America since 2005 should make all of us viscerally sick. (And that is a number from less than 1/2 of the law enforcement agencies because the others don't report such figures to the FBI.)

In Ferguson, three minutes — and two lives forever changed

................

A key witness — Brown’s friend Dorian Johnson — has told the FBI that he thought the robbery was a “prank,” said Johnson’s attorney. In an interview with federal agents, Johnson has said Brown was hit by one bullet, then — as Brown pleaded for his life — Wilson fired “five or six” more times.

And when the shooting stopped, Johnson and his legal team have told investigators, the police officer who pulled the trigger did nothing to save the man he’d just shot. “The officer doesn’t attempt to resuscitate,” Johnson’s attorney, former St. Louis mayor Freeman Bosley Jr., said in an interview Saturday. “He does not call for medical help. The officer didn’t call it in that someone had been shot.”

............

Both men are now forever entwined with Ferguson, but neither had particularly deep roots here.

Brown was only spending the summer with his grandmother while making plans to attend a vocational school. Wilson was in his fourth year on the police force after working for two years on a force nearby. He lives miles away in a house with a swimming pool in the suburb of Crestwood.

Nurse On Site Was Not Allowed to Tend Mike Brown

From a NY Times report:

Mr. Stone ran outside and saw two police officers, both both white men, standing near Mr. Brown, who was lying on his stomach, his arms at his sides, blood seeping from his head. Another neighbor, a woman who identified herself as a nurse, was begging the officers to let her perform CPR.

They refused, Mr. Stone said, adding, “They didn’t even check to see if he was breathing.”

UPDATE, just found this:

Singer Thee Pharoah, 27, witnessed Michael Brown being shot by Officer Darren Wilson outside his Ferguson, Missouri, apartment Saturday

The rapper shared two photos from the crime scene, one of them showing Brown's corpse in the street

Thee Pharoah wrote that Brown was running when he was shot twice in the back and five more times as a 'barrage' after he turned around

(Picture removed -in respect to his mother)

Pharoah shared a picture of a police officer, believed to be unrelated to the shooting, walking with a rifle in his hand near the victim's body hidden from view by a screen

(pictures here are graphic, but revealing):

UPDATED TO INCLUDE:

Another witness has emerged in the shooting of Michael Brown
:

?1408031070

Mitchell told News 4 she saw a door close on a police car. An officer was inside and Brown, Jr. was on the outside. She said the two were arm wrestling through the car window. Mitchell said she then tried to pull out her phone to record. Shots then rang out.

“It just didn’t look right for them to be arm wrestling,” Mitchell said. “The first gun shot came from the window, so I just started getting out of the way.”

According to Mitchell, Brown, Jr, began to run away after the first shot was fired.

“After the shot, the kid just breaks away. The cop follows him, kept shooting, the kid’s body jerked as if he was hit. After his body jerked he turns around, puts his hands up, and the cop continues to walk up on him and continues to shoot until he goes all the way down,” Mitchell said.

Shot twice then five more times? That equals...somewhere around seven. My knowledge of weapons only comes from television, though. I thought six was the 'magic number' of most hand guns.

How many bullets does the police handgun hold typically?
Answer
15 and up.

Actually, it depends. Many police departments in the U.S. use .40 caliber handguns. Some Glock handguns (the model 22, for instance) hold 15, but the Glock 23 holds 13. Sig .40 caliber handguns hold 12.

That said though, some agencies still use 9mm, although, depending on the model, some of those hold 11 or 12 also.

Sun Aug 17, 2014, 11:28 AM

Don't demonize them, like they demonize us, liberals, minorities, the poor etc. When we demonize them, we join their team. They are not demons, they are ignorant people, whose minds are filled with delusional perceptions, false assumptions, prejudices based fear and hatred and arrogance.

We can just simply and objectively tell the truth based on our observations. The cop was trigger happy and out of control. He did not control himself. Rather than getting out of his car, and politely asking the teens to get out of the street FOR THEIR SAFETY and the safety of motorists, he over-reacted. He exceeded his authority, resulting in a needless death. He also could have followed the boys home and talked to his parents, who would have lowered the boom.

That cop needs to be prosecuted for 2nd degree murder, or manslaughter at the very least. A grand jury needs to be enpaneled for an indictment to begin the wheels of justice moving.

In Missouri Capital Murder and all that entails. What makes this so rare there were so many wittinesses. It will also be interesting to see the Police Departments Standard Operating Procedures for Deadly force. Denial of first responders such as the Nurse also is a problem.

This entire situation will hound City Government in Court for years to come. I hope it ruins the Police Chief of Ferguson into what should be impending retirement. He has his years in and probably knows it allowing him to be total tool in stirring up chaos. It is a miracle others have not been killed.

Sun Aug 17, 2014, 02:25 PM

He went the the FBI Academy for police. When I was a little girl, he explained to me the differences between the different types of homicide.

1st degree is a planned murder. You plan out how to murder someone, sometimes in conspiracy with another person who becomes equally guilty. You get up in the morning with the intention to enact that plan. You lay in wait for them with stealth, like when you hide in the bushes and pounce, or poison them when unsuspecting. Or you attack when they are vulnerable, like when sick or injured.

2nd degree is not preplanned. You lose your temper and lash out in rage, resulting in a death. If you shoot someone during an armed robbery, that's usually 1st degree murder, but the prosecutor has the discretion to charge 2nd degree.

Manslaughter is when your actions result in a death, like a car accident. But if you're DOI, it could be 2nd degree if you've had previous DOI convictions.

Negligent homicide is when your inattention to your responsibilities results in a death. Like when a mine owner fails to correct a safety issue that he knew about. Or when a coach sends a player who suffered a concussion back on the field.

Each state defines the different types of homicides differently.

Sun Aug 17, 2014, 07:15 PM

"getting up in the morning with the intention to enact that plan"

Colorado's statute states (and I assume other states have similar laws):

A person commits the crime of murder in the first degree if:
(a) After deliberation and with the intent to cause the death of a person other than himself, he causes the death of that person or of another person; or

http://www.lawinfoboulder.com/colorado_statutes/murder_first_degree.html

It only has to be a deliberate action, as opposed to a "heat of the moment" thing. As stated in this decision:
The premeditation or deliberation requirement of first degree murder does not require a "plan" or protracted consideration of the killing by the defendant. Instead, it requires only the time necessary for one thought to follow another. Hinton v. People, 169 Colo. 545, 458 P.2d 611 (1969); Hammil v. People, 145 Colo. 577, 361 P.2d 117 (1961).

http://law.justia.com/cases/colorado/court-of-appeals/1991/90ca0162-0.html

My sister-in-law was murdered by her abusive ex-husband, and he was convicted on a first-degree charge. The circumstances were as such:
They had an argument during which he left the house to get his gun out of his truck. She locked the door. After getting the gun, he broke down the door in order to get back in the house. At some point, the phone was ripped out of the wall (no cell phones back then), presumably so that she could not call for help. He shot her in the head in front of their youngest child, after first pointing the gun at various parts of her body then removing the safety.
The facts above were enough to meet the "deliberation" and "intent" portions of the statute. Yay!, since first degree murder in CO has a mandatory life sentence, with no possibility of parole for 40 years (at least at that time). If we had only gotten a 2nd-degree conviction, the fucker would have been out in a couple of years at most, and probably would have tried to get custody of the young children.

Oh, they might offer up a sacrificial lamb or goat to appease the masses. But the reality of racist America and the militarization of our Police won't change. The 1% need the bread and circuses to keep the masses distracted. FOX fans the flames of racism and hatred so that the masses vote against their own self-interest so that "they" don't get any of "my" tax dollars. We already have two branches of government bought and paid for by the likes of the Koch brothers.

This won't end well for America. We will either end up a Fascist police state like the Soviet era USSR or we will tear ourselves apart with a violent revolution where it is 'us" vs "them" - where it starts out with the 99% against the 1% but, like the French Revolution devolves into "them" being anybody not like me - Christians against Muslims, black against white, white against anyone who is not white, and so on.

The 1% seems hell-bent on getting rid of any and all social safety-net. And when parents can't feed their kids, that's when things get really ugly.

The above may be a little incoherent. It is just that I am just so mad and so disparing of my country.

I confess this is as far as I have gotten reading the wpost article, but but and wtf

When they met at 12:01 p.m. on Aug. 9, the two were coming from different places, different mind-sets —Brown filling free hours with a friend, Wilson coming off an emergency call about a 2-month-old baby struggling to breathe.

Brown, barely 18, stood 6-foot-4 and 292 pounds and wore a St. Louis Cardinals baseball cap. Wilson, a lanky 28-year-old with short-cropped blond hair who had six months earlier won a commendation for “extraordinary effort in the line of duty,” steered a police cruiser behind him.

Now. I will read onward.
