(4,787 posts)Kagan voted the same way as Ginsburg did every time, with the exception of one case which involved a state's ability to sue an Indian tribe. (There were 10 cases with 5-4 decisions.) In the case where Kagan disagreed with Ginsburg, Michigan v. Bay Mills Indian Community, the vote was 5-4 for the Indian tribe. Guess what? Ginsburg voted with Scalia, Thomas and Alito and against the tribe. Is she a....?
Personally, I think she was a great choice.
