2. I have never heard of a President giving a pardon

Before leaving office. President Obama will give his list of pardons in January 2017. Has there ever been a time a pardon was given earlier?

A pardon is an executive order vacating a conviction.[2]
A commutation is the mitigation of the sentence of someone currently serving a sentence for a crime pursuant to a conviction, without vacating the conviction itself.[3]

5. I will do that. However Don Siegelman was falsely convicted by a bunch of Right Wing

criminals starting with Karl Rove and his minions not to mention the judge, who was recently arrested for domestic abuse and will or did get a slap on the wrist.

I think people should also be calling the DOJ demanding that they rescind that conviction completely considering all the evidence of corruption involved in that case. A pardon will get him out of jail, but will not restore his excellent reputation.

This DOJ did exactly that for Republican Sen. Ted Stevens, they overturned that conviction due to some shenanigans in that trial, which didn't even compare to what went on in Don Siegelman's case.

But they refused to do the same for Gov Siegelman.

6. When Attorney General Holder appeared before the House Judiciary Committee in May of last year,

..Rep. Steve Cohen (D-TN) asked him to free Governor Siegelman.

"This week at a House Judiciary Committee Hearing, I asked Attorney General Eric Holder to free former Alabama Governor Don Siegelman from prison because he was a victim of a politically motivated prosecution."

he did for Ted Stevens' case.

12. When Siegelman appealed his case to the U.S. Supreme Court in 2009, ..

..President Obama's Attorney General, Eric Holder, dispatched Solicitor General Elena Kagen to argue against the appeal.

10. Holder can't do to Siegelman what was done to Stevens.

Stevens had been convicted but not yet sentenced when it was found prosecutors had withheld evidence of his innocence. Holder moved to dismiss the case, which he could since there had not been a sentence imposed, and the judge agreed. The judge held the prosecution team in contempt and Holder fired them as well as most of the top people in that division.

Siegelman has already been sentenced so Holder has no power to free him even if he wanted to. The only power is in Obama's hands who could pardon him.

11. The DOJ has the power to investigate what was called a corrupt, politically motivated

conviction. Not just by Democrats, but by many Republicans also. Holder'sDOJ actually asked for MORE TIME for Don Siegelman, see the post above yours and the link in the OP.

So the DOJ CAN intervene in a case where sentencing has already been decided.

So tell me, if the DOJ can ask to INCREASE the time of someone whose conviction has been so controversial across the political spectrum, three years AFTER the trial, then why on earth is that power nonexistent when it comes to ordering a NEW TRIAL due to the overwhelming evidence of corruption in that trial?

What you are trying to tell us is that the DOJ has no power except, well, sometimes.

Sorry, but you are wrong. There is simply no excuse as to why this egregious miscarriage of justice has been allowed to stand for all these years despite the evidence of corruption and the witnesses who have testified to that corruption.

Holder's DOJ failed the people when they not only refused to investigate thoroughly the criminals involved in that trial, but asked for MORE time for Siegelman.
