Could a special prosecutor be appointed…? (Original Post) MrMickeysMom Nov 2014 OP
I believe so. Double Jeopardy does not apply. Wilson is still at risk of charges. NYC_SKP Nov 2014 #1

I would expect that state or federal charges could be filed.

I don't, however, know if local charges can be refiled.

I dunno…. I'm trying to fathom this being one last chance.

I'm sure so many are so tired at this point, still reeling (even though they knew this would be the result of the grand jury), that this is going to HAVE to happen.

Thanks.

and I enjoy hearing so many interesting thoughts from others here too.

Thank goodness there's a lot of really good people here at DU who don't just accept the word of a prosecutor who is trying his best to exonerate and defend the police at all costs. I try not to wish ill will on anyone. But I think one of the positive changes that can occur, on a very small level, is to elect a prosecutor who better represents the people of Ferguson.

Of course, on a bigger level, let's all do what we can to reduce the inequalities in our society. In every possible way, locally. No action is too small.

Hope you enjoy a great evening.

Federal charges would have to prove civil rights violations and that will not happen either.

U.S. Justice Department officials probably will not bring civil rights charges against a white Ferguson, Missouri, police officer whose fatal shooting of an unarmed black teenager set off rioting in August, the Washington Post reported on Friday.

The newspaper, citing law enforcement officials, said investigators had all but concluded there was not a sufficiently strong case to prove officer Darren Wilson violated the rights of 18-year-old Michael Brown when he killed him in the St. Louis suburb on Aug. 9.

U.S. Attorney General Eric Holder said last week he expects the Justice Department's investigation into the shooting to be complete by the time he leaves office.

I still see the words, "probably will not bring civil rights charges…"

We, the people who have civil rights, have to keep everyone's feet to the fire, and here's one that's going to walk out before we can hold on to those feet.

Do we have to do EVERYTHING, including make the case? That's a rhetorical question, BTW.
