Cop Who Killed Eric Garner been sued three times for allegedly violating constitutional rights

NEW YORK — The white New York City police officer whose choke hold led to the death of an unarmed black man has been sued three times for allegedly violating the constitutional rights of other blacks he and fellow cops arrested.

A grand jury decision not to indict Daniel Pantaleo on Wednesday in the death of Eric Garner, 43, the man he wrestled to the ground during an attempted arrest for selling untaxed cigarettes on a Staten Island sidewalk in July, sparked waves of angry though largely peaceful demonstrations in several cities.


Officer's intent critical for grand jury in choke-hold case


The Garner case wasn't the first time Pantaleo, 29, was accused of misconduct, however.

Darren Collins and Tommy Rice alleged in a 2013 federal court lawsuit that Pantaleo and at least four other officers subjected them to "humiliating and unlawful strip searches in public view" after handcuffing them during a March 2012 arrest on Staten Island.

and the officers thinking they had almost god-like rights to do whatever they felt necessary. Truly despicable but I can't help thinking we are all a bit culpable in letting it get this far.

The most blatant and obvious case that proves beyond a shadow of a doubt that the War on Drugs is not about keeping you safe from drugs:

Huntsville, AL police killed a 17-yr-old teenager by ripping his throat open to get the drugs he swallowed. "We have to kill you to keep you safe from DRUGGGGGSZZZZZ!!!!!!"

... Constitutional and Civil Rights. Holder needs to fast track these Federal investigations. Otherwise, the white pigs are going to continue right on killing unarmed innocent citizens of color. And every single time they do it, the people will be in the streets all over this country stopping the machine. And the longer it goes on, the bigger the protests will get. And that's not a threat. It's a promise.

But I am so impressed with the leaders that put these protests in motion. And none of them push for the spotlight. They lift each instead.

What they need to do is continue to investigate to see if they can build a case that has a good chance to get a conviction and survive on appeal where as fast tracking an investigation because you are afraid there will be more protests could risk the whole thing collapsing.

build an airtight case, win, and set a precedent that relates to this brutality that can be cited in subsequent cases of this nature? Otherwise I still agree with ReRe about the protest, larger and larger and larger until the side a person is on is an unmistakable fact.

Most of the protests around the country have been peaceful.

The suggestion: "in the streets all over this country stopping the machine." doesn't necessitate violence. They've been shutting down malls and highways....peacefully.

But in the current zeitgeist, I can see why violence came to mind.

Despite the NYPD banning chokeholds in the 1990s, New York officer was accused of putting someone in a chokehold, on average, every other day from 2009 through the first half of 2014

Y'know, I'm glad there are cops.

Then, well, I'm white.

But I simply don't get it: These awful examples of policemen not only endanger the general public and especially whatever type they don't like, but all good cops too! How can the cops who, even if they don't like blacks or latinos or whomever, BUT STILL operate by the rules and react to situations according to their training.... and of course those cops who aren't prejudice.... how can they put up with these jerks who endanger them and everybody else?

Semper fi and camaraderie and all that is great, but this isn't a sporting event, y'know! And it shouldn't be the special situation of war either.

to uphold laws or protect people. Until the people of this nation take back their cities it will get worst. With the NRA and the GOP controlling the states and nation, it gonna get back for the people.

he didn't die from a choke hold, he died from a heart attack. He died because the gang of cops that took him down declined to administer CPR to him. He died on the sidewalk of a heart attack because nobody rendered aid. you should keep that in mind as you watch the video of all those cops standing around looking at him for 9 minutes.

but IMO the choke hold which is illegal was the beginning of Eric's demise. The big fella scared those cops by being a large man. They seemed to attack him like a pack of wolves. SMH!!!

Eric Garner, the Staten Island dad who complained that he couldn’t breathe as he was subdued by cops, died from compression of the neck, the medical examiner said Friday.

The autopsy also found that compressions to the chest and “prone positioning during physical restraint by police” killed Garner. The manner of death, according to the medical examiner, was homicide.

Uh yeah, pretty sure all cops have CPR certifications. Not to mention that there is a duty to act, and the public reasonably expects cops to be able to do CPR on people. Thats part of the HOMICIDE cause of death ruling.

the choke slam was a take down manuever, not a defense combatives move.
