A birth certificate and driver's license isn't enough to clear the Arizona law and be released from confinement --technically.
There is nothing prior to the birth certificate which proves legal residence (but Arizona's law requires that proof BEFORE the document used to prove legal residence is granted)
Following the law, one would be taken into custody. However, there's no national database of US Citizens, especially ones already born here but without passports. So, in that case, in many cases, if you don't have a passport, the US Government cannot verify that you are here legally. Think about it, what document does the US Government have on you that proves you are here legally --for example, say you have never left the country, or even your own state!
And if all you have is your birth certificate and driver's license, but you're in one of the states that doesn't require proof of citizenship to get your Driver's License, then a Driver's License plus passport doesn't confirm you ARE NOT an "Alien".
Now, back to the birth certificate, why isn't it valid? Well what verification does the state have before it grants you a birth certificate? (besides the word of the Pope and Pat Robertson?)

Birth Certificates ARE NOT VALID as identification under the Arizona law.

This law is a travesty. It says that the state considers you to be guilty of something unlawful which you have to prove your innocence. Further, when you examine it further, it may not be able to prove that a person fully legal under US Law, with the proper documents could prove themselves not here unlawfully.

If I weren't living in these times, I wouldn't believe any of this.
Our future generations will never know how dangerously stupid things are today because the right will re-write the whole damn thing. Oh, hell, maybe they'll blame it on the left, and those 80 Commies in the House.
I want to say more - seriously - but I just don't know how to put it all into words.
