Judge: Fla. worker drug testing unconstitutional

A Miami federal judge has declared that Gov. Rick Scott's order requiring drug testing for state workers is unconstitutional.

U.S. District Judge Ursula Ungaro ruled Thursday that blanket testing of some 85,000 workers violates the Fourth Amendment ban on unreasonable searches and seizures. The ruling could eventually have an impact on a new state law also permitting random worker drug testing.


This is a start. Now to get him and the rest of these nutbags voted out of our state. We need to take back our state once and for all

When a judge actually follows or pays attention to the constitution, rather than rejecting it for whatever the popular attack on privacy of the day happens to be.

yeah I know it's because it's a government job but unequal protection is unequal protection.

Though knowing this state, it wouldn't surprise me if this guy actually got another term. I can already imagine his campaign slogan, "Drug Test Food Stamp recipients".

It's a Federal law for transportation workers in "safety critical" positions. The last time was just a couple weeks ago. It's annoying and unconstitutional, but nobody cares. I've gotten quite used to filling up the bottle and blowing in the tube in order to go to work.

It wasn't a blanket drug testing policy for the entire Government - just teachers or police.

I'd like to see such rulings applied to private business, along with credit checks too. But how would that benefit the wealthy????

abusive "laws" the GOP enact is not that they're unconstitutional. We all see through that. It's not that it's written to address a pandemic of illegal activities, but for the constitution, can't be enforced. It's that they're written just so the GOP can financially benefit by having companies they own or their friends own get paid to do the job of the law. We all know that Rick Scott's wife owns drug testing centers. This rule was written so she gets money from the gov't paid to her to do a job. A job created strictly just to benefit her company.

I believe this tit-for-tat situation is precisely a clear example of national socialism, or nazism.
