A Miscarrying Woman Was Denied Medication Because of “Conscience”

Earlier this month, in my piece about the Purvi Patel “feticide” case in Indiana, I predicted increased harassment of women who are miscarrying, on the suspicion that they're trying to obtain misoprostol to induce abortions. (Because the drug expels the contents of the uterus, misoprostol can be used both in abortions and to treat incomplete miscarriages.) That day has come already to Milledgeville, Georgia, where Brittany Cartrett claims that a pharmacist refused to fill a prescription for misoprostol that her doctor prescribed for her miscarriage.

Cartrett explains on her Facebook page:

After discussion with my Doctor, we decided to go the less invasive route and choose a medicine that I could take at home to help miscarry naturally, especially since my body wants to hold on to the little miracle. I get a phone call from the doctor stating that the ‪#‎Walmart‬ in Milledgeville, GA (yes the one I used to work at) doesn't feel comfortable with filling this prescription. She was going to call and figure out what is going on and call me back. Well about 5 minutes later she calls and says, "They won't fill it. They won't tell me why. But they won't fill it." So we find another place to fill it and I thank her. ....They WON'T fill it. Not that they CAN'T. But they WON'T. Now, I have another prescription there that I have to get. So I go up to Walmart and I get my prescription and the #Walmart pharmacist comes to me for my consultation and asks If I have any questions. I tell her yes, but not about this one. I ask her why they refused to fill the other prescription I had. She looks at me, over her nose and says "Because I couldn't think of a reason why you would need that prescription." ..... Excuse me?! I tell her my reasons for needing it, and she says "Well, I don't feel like there is a reason why you would need it, so we refused to fill it."

1. Pharmacists are not qualified to practice medicine.

These pious assholes are begging for a huge lawsuit from the first woman who has retained part of a miscarried fetus and subsequently needs surgery and/or hospitalization for sepsis.

That lawsuit will be a beaut, too. It is going to happen. It's just a question of when.

2. this was posted when it happened, but the reminder that the insanity is ramping up is necessary.

pharmacists who don't want to do their jobs should get another job, preferably one where they never come in contact with the public.

3. What Cartrett should have replied to that idiot pharmacist

was something along the lines of "You are not my doctor, you have absolutely no knowledge of exactly why this medication was prescribed. I can't think of any reason why I should ever patronize your store again. Nor can I think of any reason why you are qualified to make judgements above that of any medical doctor."

If a pharmacy I'd been going to refused me a prescription for any such reason, I would NEVER go back again. Never.

the big three. This incident is atrocious. As a young person with a medical situation like that I don't know that I would have been able to come back that strongly or quickly. It shouldn't be necessary with anyone but esp. a Pharmacist, clearly one who is acting above their authority, feeling the power and judging because someone is in need, of their dang product.

Makes me wonder what this country is becoming, Stalinist Russia, totalitarian RW fascist US? Distressing for the woman and in this land of the 'free'? When I mention things like this to some, they don't believe it. 'That can't be happening, or it's rare' they must think. Tiring, I need a Support Group for the politically informed, but in person! There's none around, I've checked.

4. Wonder if she could sue the pharmacist for practicing medicine without a license.

Overruling the doctor would make it appear she's trying to act as a doctor.

6. In this era, I bet only if there were serious health consequences would a lawyer take the case

without a sizable retainer now. If someone has the funds yes. It appears there are fewer and fewer legal aid type organizations anymore, I could be wrong but.. Also there usually has to be provable neglect, damages and consequences for 'recovery' regarding physicians for sure. Reminder, always good to have a lawyer friend or family member. The excellent film, 'The Verdict' with Paul Newman crosses my mind.
