The passage of time from the first attested out-cry against the victim establishes pre-meditation and criminal mind, and the attested statement establishes the animus against a group required for a hate-crime enhancement.
Most places he ought to be looking at six or so years....

(33,688 posts)deadly weapon. Depending on the state, a bump up to hate crime status would certainly be possible if there's a specific statute. A civil lawsuit would also rest on firm grounds if the victim suffered bodily harm.
