Ex-congressman plans malpractice suit against feds

Former Rep. Steve LaTourette, who’s severely ill with pancreatic cancer, is planning to file a medical malpractice lawsuit against the federal government, accusing Capitol Hill doctors of failing to provide him with information that could have led to an earlier diagnosis.

The Ohio Republican, who was diagnosed last year, filed administrative claims against the government for what he says was negligent care from the Office of the Attending Physician of the U.S. Congress, which oversees lawmakers’ primary care. The filing is the first step toward a lawsuit.

According to a court filing, a MRI scan in March 2012 — after LaTourette had been hospitalized twice that year for mild pancreatitis and gastrointestinal pain — showed a lesion in his pancreas. His radiologist recommended follow-up care to a congressional physician, but LaTourette said he was never informed of that recommendation or the MRI results.

LaTourette said a visit to his personal physician last summer, months after his retirement from Congress, revealed he had pancreatic cancer.

The nine-term former congressman is planning to sue for past and future medical expenses, lost wages and compensation for his mental anguish and suffering, his lawyer said in an interview.
