Personally I give her 24 hours.
Here's what's going to happen. She's going to come to work at her county clerk's office tomorrow. Right on schedule, a gay or lesbian couple is going to walk in, and ask for a marriage certificate.
As she promised, she's going to come out of her office with her sledgehammer saying "I'M NOT GIVING YOU A COCKADOODIE MARRIAGE LICENSE, YOU SINNING DIRTY BIRDS!"
Judge Bunning isn't going to have a sense of humor about having his court orders openly defied. He won't just summon her for a hearing later this week. No, he's going to stop what he's doing, order Federal Marshals to go and get her, and by closing time tomorrow, she's going to be back in Club Fed.

She deeply deeply hates Gay people, I mean HATES them, and wants to show the world, but to do that she has to go to jail.
What is a stupid bigot to do?

(26,355 posts)He warned her multiple times, gave her a taste of consequences over the extended Labor Day weekend, and let her out under strict orders not to interfere with the issuance of marriage certificates to all legally eligible couples.
If she defies his orders, he won't have a sense of humor about it. He's going to make his punishment harsh enough to really make her regret pissing him off. He won't just put her in jail for a week. He'll give her at least a month, maybe a full 60 days before he has another hearing to see if she's willing to be cooperative.

I think he's given her every reasonable opportunity to get her act together. I do think too that he will throw the book at her.
She is trying to rip a hole in the division of church/state, nearly everyone knows/sees what her shenanigans are about and her herd of lawyers.
I sincerely hope he does throw the book at her. If this is allowed to continue, it is eroding authority in the country. We are ruled by laws and fairness, not some religious sect. If she can't hack the job, then she needs to resign, but noway does she want to give up the cushy income from that job.
She is like a spoiled brat. And she is using her power and office to thrust her brand of religion onto others while doing so in a public office. In fact, she is un-American.
I think what will happen is the US Marshals will be ordered to escort her straight from the clerk's office to jail if she gives the judge and SCOTUS the finger again.

(23,272 posts)The problem here is that the attorney says she has not changed her mind, that Kim Davis is adamant that as long as her name appears on those marriage licenses, she objects and she will attempt to stop those licenses from being distributed, CNN correspondent Martin Savidge said during a live broadcast.
So I'll bet she's back in jail by tomorrow afternoon. Hopefully this time she gets jail and fines.
Bunning needs to make this hurt for her.

Maybe early next year when the Kentucky legislature is in session, they might change the relevant laws, but until then, her name must be on the certificates, even if she's cooling her heels in jail when they're issued.

Marriage licenses obtained by three couples in Rowan County were altered so that they did not include the name of county Clerk Kim Davis, who had been jailed for refusing to issue licenses because of her opposition to same-sex marriage.
However, Gov. Steve Beshear and others said the licenses for the three couples were valid even without Davis' name on them.
Under state law, deputy clerks can issue licenses and perform other duties just as elected clerk can, said Allison Connelly, director of the University of Kentucky's Legal Clinic.

(12,977 posts)I'm starting to get confused about what she actually said when -- and whether she had to agree to accept those licenses as valid before she was let out of jail. But going by the statements of her lawyer, I don't think anything has actually changed.
And that leaves two questions. One is what happens to new license applications going forward. The other is whether she can interfere in the process at a later point, such as when the marriages have taken place and it's time for the person who officiated to file the certification.

So, she may THINK they aren't valid but, it seems, her opinion carries no legal weight.

(23,272 posts)If you listen to her brief remarks at her support rally today, she's completely unhinged about this. I believe she feels "vindicated" by the Lord who let her out today.
I think she's gotten a taste of the Fundie acclaim that goes with martyrdom and won't stand by tomorrow and let her clerks just issue the licenses. Can you imagine her sitting meekly at her desk watching that go down? I can't.

No way. In her mind Gawd has shown his power through her.
My bet still stands at tomorrow afternoon. I'd be thrilled to be proven wrong though and that she surrenders this fight now.

(23,284 posts)give any applicants the stink eye. She's already agreed to let her deputies issue them. I think her emphasis now will be on "Here, take the license, for all the good it will do you. They're worthless without MY name on them."

(12,754 posts)Whether she will file and record the licenses once they are returned by the officiant. If she doesn't do that, the marriage doesn't officially take place. In fact, that's a more crucial step than issuing the license. If the completed license isn't in the files, the couple can't prove they are married.
If she chooses to shred them, it's going to be a colossal mess.

If convicted, she will be forced to resign her position.

First thing tomorrow she will refuse to issue marriage licenses. Then someone will turn her into the court and Thursday the court will summon her to appear on Friday and then she will go back to jail.[/font]

I think the judge let her out--hoping she'd had enough--because, frankly, he'd had enough
of the asshole protesters in front of his house over the weekend.
But he will be pissed she doesn't get it. And he will leave her there until she finally decides
to agree to let her deputies issue the licenses or resign. And she's not going to resign,
because Farmer Joe won't let her...and according to her religion he's head of the house
and she has to do what he says.

If she sticks to that, she could go back sooner than she thought. Any couple that's denied can do her in.

I'll bet my bottom dollar Davis will continue to abuse her authority with her pig headed, unlawful and hateful
agenda.
There has to be a method and purpose to their madness; as in now that the base is really fired up, and Davis
has vowed to persist with her BS, her followers will be gathering and waiting for the federal marshals to
escort her from the building and make and even bigger public spectacle.
