MOREHEAD, Ky., Sept 12 (Reuters) - The county clerk from Kentucky who was jailed after refusing to issue marriage licenses to gay couples has asked an appeals court to let her continue her stand until a lawsuit against her is decided.
Rowan County Clerk Kim Davis, due back at work Monday after six days behind bars, has said her beliefs as an Apostolic Christian prevent her from issuing marriage licenses to same-sex couples and her attorneys have said the 49-year-old woman will not violate her conscience when she returns to work.
In her absence, deputy clerks have been issuing licenses and have said they would continue to do so.
Davis was jailed when she refused to comply with U.S. District Judge David Bunning's order to issue licenses. He ordered her released when the deputy clerks began issuing the licenses.
In a Friday motion filed with the Sixth Circuit U.S. Court of Appeals, Davis' attorneys asked that she be allowed to continue banning marriage licenses for her entire office until the case is settled.

I hope she tries and stops a clerk, the clerk refuses, she tries to discipline him/her...a wrongful termination suit against her might finally get the county and/or state legislature to start the process of getting her out.

And the theocratic GOP seem to not understand the US Constitution. Especially Hucklebuck.

I think Kim will find herself in jail again before the week's out. Judge Bunning is not going to suffer her defiance again.

She's tool and she's not worn out yet. They won't be done with her until she is of no further use to them, is my thoughts.

This could turn into a nasty situation.

(82,849 posts)Because pushing a conflict to the brink of armed insurrection worked so well in the Cliven Bundy episode. Law enforcement backed down, Bundy remained free, a bunch of pin-dicked bugfuckers got to parade around with their weapons, and sight down on federal officials. All without any repercussions.
If the Oathkeepers push the confrontation to the point of insurrection, they have every reason to believe that the feds will back down again, they'll all get to posture with their guns and rifles, strut like peacocks, bully people who disagree with them, and maybe sight down on a few more federal law enforcement officers. No downside, and they get their way again.

(21,560 posts)It wasn't worth it to the Feds to start a war over some lazy moocher stealing grass. But I don't think law enforcement will be so generous if they try to interfere with the constitutional operation of a county clerks office. Now we are getting darned close to anarchy and the total loss of the rule of law.
You are very much correct though that the bundy situation has emboldened these fools into thinking they can get away with this shit. They should have went back in with greater numbers and thrown that scumbag in prison along with anyone threatening them with a weapon.

(82,849 posts)But you know there will be those advising President Obama that Mrs. Davis' dereliction of duty is no more serious than Cliven Bundy's unbroken string of lawlessness. The argument will be, "Do we really want to get shooting over such a minor issue? How will this play across the country, federal agents shooting citizens?"
I don't want anyone getting shot, but it's difficult for me to imagine a scenario where nobody shoots, Davis complies with the judge's order or goes to jail again, and the itchy trigger-finger brigade goes home unrequited.
