According to current law, those “engaged in the business” of firearms dealing are required to be federally licensed, and must then subject buyers to background checks. But the law exempts any person “who makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of his personal collection of firearms.”

It is how the law was designed as stated in the article. All dealers and FFL holders must by federal law perform background checks even at gun shows and over the internet. All sales that cross state lines must have a background check. Several states require all transfers to have background checks. Federal law does not cover intrastate sales between two persons residing in the same state. That is a state matter. In plain language, there is no loophole that allows all firearms sold at gun shows to be exempt from background checks.
