Three more arrested in Oregon Standoff

http://www.cnn.com/2016/01/28/us/oregon-wildlife-refuge-siege-arrests/index.html

Eight people left the refuge on Wednesday. Three of them were arrested, including one of the new leaders of the group, Jason Patrick.

Each faces a federal felony count of conspiracy to impede officers of the United States from discharging their official duties through the use of force, intimidation or threats.

"All were in contact with the FBI, and each chose to turn himself into agents at a checkpoint outside the Malheur National Wildlife Refuge," an FBI statement said. "The arrests were without incident."

My recollection is that he said something like "I wouldn't necessarily have gone about it this way" -- some fairly mild disapproval but still disapproval.

I think it was the kids trying to outdo Dad, kind of like Shrub pushing on to Baghdad after his father sensibly saw that overthrowing Saddam would be a disaster.

It's obviously a conspiracy and they obviously broke the law. I think RICO applies. Not 100% sure, though.

While it was apparently a State police officer shot at, it was in the commission of a Federal felony, not a State felony.

Even had they been in the commission of a State felony, felony murder is limited to a handful of very select felonies, not all felonies.

Making a Federal Case out of a Death Investigation
C.J. Williams
... There are many statutes which provide that if a person is killed while the killer/defendant is committing another federal felony offense, federal jurisdiction exists over the murder itself ... When death results from the commission of a federal offense, it increases the statutory maximum sentence, sometimes exposing the defendant to capital punishment. Of course, any fact having the effect of increasing a statutory maximum sentence must be alleged in the indictment and proved to the jury beyond a reasonable doubt. In non-capital cases, what it means for a death to "result from" an offense may differ depending on the statutory language. There is a presumption that the government must prove the underlying illegal conduct was the proximate cause of the death. This presumption can be rebutted ...

But then, I kind of figured this was how it was going to end. Revolution always sounds like fun, but when the prospect of dying becomes a reality, one may start to realize that a couple of locked up poachers and allowing your cattle to shit and eat wherever you want maybe just isn't a cause really worth ending your life over.

UPDATE: One man abandoned the refuge, leaving 4 holdouts left #OregonStandoff http://bit.ly/1nB69mK

9:30 a.m. Thursday: Stewart Rhodes of Oath Keepers reports that a Montana man abandoned the refuge this morning, leaving just four occupiers. David Fry, one of those left, posted a Youtube video Thursday morning saying that one occupier did leave and that four are left. "We're kind of waiting around to see what happens. We're waiting for a phone call," he said on the video.
