One of the last holdouts in the armed takeover of an Oregon wildlife refuge said Thursday the remaining five occupiers will leave if they receive assurances none of them will be arrested.
In a video posted on the YouTube channel DefendYourBase that the group has been using to issue updates during the nearly four-week-old siege, a speaker believed to be David Fry said the occupiers have been told by authorities that out of five people left here, four of us are allowed to leave.
The FBI had no immediate comment on the demand. It has said only that it is trying to empty the refuge of the armed occupiers in the safest way possible ...

BURNS, Ore. Nearly all the armed protesters who had overtaken a U.S. wildlife refuge in southeast Oregon have cleared out following the shooting death of an outspoken member and repeated calls from their jailed leader to stand down.
By Thursday, only four protesters remained holed up inside the group's headquarters at the Malheur Wildlife Refuge outside of Burns, Oregon, FBI Special Agent in Charge Greg Bretzing said at a Thursday night press conference.
At least nine occupiers left the compound after law enforcement surrounded it after the arrest of protest leader Ammon Bundy and other members of his group Tuesday evening, Bretzing said. Of those, six were released and three Jason Patrick, 43, of Bonaire, Georgia; Duane Leo Ehmer, 45, or Irrigon, Oregon; and Dylan Wade Anderson, 34, of Provo, Utah were arrested by FBI agents outside the occupied federal compound late Wednesday.
As with the other arrested protesters, the three men face a felony charge of conspiracy to impede officers of the United States from discharging their official duties through the use of force, intimidation or threats ...

BURNS, Ore. (AP) A video released Thursday by the FBI of the shooting death of a spokesman for the armed occupiers of a wildlife refuge shows the man reaching into his jacket before he fell into the snow. The FBI said the man had a gun in his pocket.
The FBI showed the video at a news conference to counter claims that the man killed in the Tuesday confrontation on a remote road Robert Finicum did nothing to provoke officers ...
The video, shot by the FBI from an airplane, shows a vehicle being driven by Bundy by stopped by police on a road. A white truck driven by Finicum was stopped but took off, with officers in pursuit. The video shows Finicum's vehicle going into a snowbank when encountering a roadblock.
A man identified by Finicum gets out of the truck, there is gunfire as he reaches into his jacket, and he falls into the snow ...

(118,224 posts)for some distance after it evaded the first roadblock; and the video shows the vehicle attempting to evade the second roadblock but getting mired in a snowdrift. Deceased exits the vehicle and raises hands initially but then lowers them and has them near his jacket front before falling, apparently when shot. Video also seems to show subsequent flashbangs

(35,693 posts)the vehicle as well as tear gas. This is probably the source of Victoria Sharp's claim about being "gassed." About the only thing she got right. Finicum shot while his hands were up? No. Finicum shot while he lay on the ground? No. Over 100 rounds fired into the vehicle? No. Five or six rounds at most fired, not clear if any fired into the vehicle, you can see the first guy who exits the vehicle after Finicum was shot throwing down a gun - not clear if he had exchanged some fire with the troopers or not. Could have been Ryan Bundy? Somehow he got shot, either from a round directed at Finicum or perhaps because he had fired on the officers. Former more likely because there was no charge of assault or resisting arrest against Ryan Bundy. In either case, the gunfire was over in seconds, it did not go on for minutes the way Victoria Sharp described it. To be fair to her, it is not that unusual for people caught up in events such as this to see and hear things which just did not happen. Adrenalin will do that. Damn fortunate everything was caught on video. Some of the militia apologists are saying, well looks like Finicum had hands up, got shot, and then put his hands down. No. He had his hands up, put them down and started rooting around his in his jacket for the gun - then he got shot and dropped to the ground. People are ignorant of what happens when you take a round in mid body mass from a high powered handgun - you do not just put your hands down. It is a physical blow which puts you on the ground. Contrary to movies and TV depictions, the only time people root around their clothing after being shot is when they are on the ground but not dead and they are trying to find out where they were hit - this happens in combat sometimes. You take a bullet in the groin or the chest, it is not as if, oh it hurts and I am going to grab that area. Nope.

HARNEY COUNTY, Ore. Some checkpoints set up by the FBI and Oregon State Police on Highway 205 near the Malheur National Wildlife Refuge were removed just after 3 p.m. Thursday.
Several hours prior, KATU reporters on the scene spotted dozens of military-style vehicles and SUVs entering and exiting the refuge.
Oregon State Police say checkpoints remain in the area, and the wildlife refuge is still closed.
According to an FBI spokesperson, the fleet of federal vehicles was, in part, negotiators working to lure the remaining occupiers from the camp. OSP eventually removed one of the barricades, which brought residents and reporters alike the closest to the refuge they have been in a few days. State police later blocked off more of the main road to the refuge ...

At their initial court appearances, most of the militants defense lawyers asked that their clients be released from detention ...
For now, Judge Stacie Beckerman has agreed with prosecutors.
Im not going to release anybody from custody, but Ill entertain it tomorrow, she said from the bench Thursday ...

(118,224 posts)The defense attorneys can explain that their clients, far from having possessed a government facility by armed mob, merely intended to have a beautiful extended outdoor church choir rehearsal and simply had not realized how their actions would be misrepresented by the news media; they can prove their clients are not cannibals but really love puppies; and then they can argue that these peaceable hardworking folk need and deserve bail so they can go back to their families and jobs

The defense attorneys are already trying to defuse the charges by calling it "detention" which is a pretty lame term.
The judge properly called it "custody" which reflects the fact that they were arrested on felony charges, not detained as material witnesses or something more benign.
I hope for some pretty high bail amounts to let those cretins out of the slammer.

(118,224 posts)Of the first few arrested, Ammon Bundy is from Idaho; Ryan Bundy and Brian Cavalier from Nevada; Ryan Payne from Montana; and Shawna Cox from Utah. In the next group arrested, only Duane Ehmer is from Oregon; Jason Patrick is from Georgia and Dylan Anderson from Utah. Of the four remaining at the refuge, Sandy and Sean Anderson recently moved from Wisconsin to Idaho; Jeff Banta is from Nevada and David Fry from Ohio. Perhaps most or all are flight risks.

... One of the lingering militants, David Fry says that he and the three others that remain have loaded up their cars and are ready to leave. But they want FBI assurances they won't be arrested.
FRY: We're waiting here, we're ready to go, we've got all our things packed. All we ask is that the police give us safe passage home without having to detain any of us.
The FBI would not comment about potential warrants for arrests for the remaining occupiers ...
