Interesting idea I heard floated yesterday about SCotUS seat

At the "Grassley do your job" event I attended yesterday, a man who is active in local Democratic politics and a former alderman as well as State Rep. floated a fascinating idea about the vacant Supreme Court seat.
There are at least 4 republican Senate seats seemingly in jeopardy because of their stubbornness among other things and the Dems could conceivably recapture or at least even up the Senate in the general election. Senators take the oath of office Jan. 3, 2017. The new PotUS takes the oath of office Jan. 20, 2017. So, maybe Obama could use executive power to appoint someone for the vacancy with Biden breaking any potential tie. I think it would be legal and I think it would REALLY piss off the teahadists.
Keep in mind that this was just one man's idea and I do not necessarily endorse it. But it sounds pretty good. It could be Obama's last act of "Screw you repuke dumbasses."

If they want to, they will. Is that what you mean?

That the Senate would change hands, and that the new Senate would vote to go into recess in order to allow Obama to make a recess appointment?

If so, why wouldn't they just confirm the nominee, which would make it permanent?

Recess appointments are temporary.

new Senate convenes on Jan 3.

1. Dem majority nukes the filibuster on SCJ appts.

2. Pres makes a normal appointment.

3. Dem Senate, with Biden as tiebreaker if necessary, votes to approve new SCJ.

I guess the elimination of filibusters on this precludes them running out the time.
