He was widely seen as a leading contender for a nomination to the Supreme Court in the Obama administration following the announced retirement of Justice John Paul Stevens in 2010.[17][18][19] In 2010, Obama interviewed Garland for a Supreme Court vacancy ultimately filled by Elena Kagan.[20] At the time, Senator Orrin G. Hatch, Republican of Utah, publicly said that he had urged Obama to nominate Garland as "a consensus nominee" who would win Senate confirmation.[20]

On March 4, 2016, The New York Times reported that Judge Garland was being vetted by the Obama administration as a potential nominee for the Supreme Court vacancy created by the death of Justice Antonin Scalia.[21] A week later, Garland was named as one of three judges on the President's "short list" (along with Judge Sri Srinivasan, also of the D.C. Circuit, and Judge Paul J. Watford of the Ninth Circuit). The president interviewed all three leading contenders, as well as two others who were considered, Judge Jane Kelly of the Eighth Circuit and Judge Ketanji Brown Jackson of the U.S. District Court for the District of Columbia.[22]

On March 16, 2016, President Obama nominated Garland to fill the Supreme Court vacancy
