Joe Vandusen says Iowa needs to change its laws

(NEWSER) Joe Vandusen had long ago moved on from his estranged wife, whom he split with but never divorced 16 years ago. Then he received a letter from the Iowa Department of Human Resources in February: "I opened it up and it was child support, for a kid that is not even mine," he tells WQAD. (The station's story is told in this YouTube video, too.) Vandusen, who lives in Davenport, says he can't be the father of his wife's 1-year-old child because he hasn't had any contact with her since they broke up. An official told him that doesn't matter.
Under Iowa law, Vandusen is legally responsible for any child born during the marriage, even if he isn't the biological father. "It shows Iowa needs to change their laws," he says. Vandusen, who cares for two biological children as well as two others with his girlfriend of five years, adds that he might take the case to court. (A Detroit man faced a similar problem.)

The child was recently born to his long estranged wife, and there's no way it is his.
"We've had no contact whatsoever in 16 or 17 years, and the child just turned one year old," Vandusen said.
But by law, Joe is still legally responsible and the state and its Child Support Recovery Unit, are telling him, he had better pay up.
"I explained to her this is not my child. I'm willing to do a paternity test and she flat out told me it does not matter, you're legally married to her. You're going to pay child support," Vandusen said.

It's the law in a lot of states: A man married to a woman, any offspring she gives birth to belongs to the husband. So scrape together the filing fee, get your wife to stipulate to a general judgment of dissolution, and file it with the court.
