Obama chose a nominee but if he wants that person to be on the court he needs Congress just like Obama did.

It's up to the Senate to hold hearings and either confirm, reject, or even filibuster (Dems didn't nuke the filibuster for SCOTUS noms).

BTW, how much do you want to bet that Drumpf will nominate someone who doesn't know his ass from his elbow about the Constitution?
