with the new SCOTUS and the new Ohio heartbeat law to challenge it.
Lisa Bloom calls a CODE RED on it.

(6,960 posts)If the Senate Republicans act boldly and get rid of the filibuster rule there could be new federal laws that effectively take us back to the 1930s when it comes to reproductive rights.

(20,854 posts)Is it Row v. Way or is it Roe v. Wade or is it something else?
Some out there don't even know what this is because THEY have slipped through the cracks as well.
Stupid is as stupid does.
By overturning Roe v. Wade the right for a woman to have a LEGAL ABORTION.
becomes a crime once again and oh yes, I remember those days only too damn well!

(34,120 posts)And how that will guarantee that the need for abortion will increase.
The right wing wants to prevent women from having control of their own bodies. They don't want women to be able to plan their families or to be able to prevent unwanted pregnancies. But they refuse to even think about how to assist women with those children once they are born.

(41,921 posts)From states with strict abortion laws. If Roe is overturned, and state after state outlaws it, there are activists getting ready to ferry women across borders. Money of course, ensures a woman will never have to worry about making her decision--for now.
This is another "wall" --an invisible one that Trump is building. U

(1,736 posts)Trump will simply be replacing Scalia with another reactionary rightwing ideologue hostile to privacy rights.
There will still be a 5 to 4 majority who will vote to acknowledge a womans right to privacy, as we saw with Whole Womens Health this year.
If Kennedy, Breyer, or Ginsburg should be compelled to leave the Court, however, while Trump is president or any Republican, for that matter then the right to privacy is indeed in jeopardy.
And if the lower courts follow settled, accepted 14th Amendment jurisprudence recognizing a right to privacy, its likely an abortion case may not make it to the Court at all.
The Ohio measure is very similar to an Oklahoma law invalidated by the Oklahoma Supreme Court, citing Casey, where no appeal was warranted.
This is not to say we shouldnt be alarmed by a Trump presidency with regard to privacy rights theres every reason to be alarmed, making it imperative a Democrat is elected in 2020; a second Trump term or Republican administration in 2021 would likely bring about the end of a womans right to privacy, the right of gay Americans to marry, and the right of immigrants to due process of the law.

(13,305 posts)Even half of Republicans thought abortion should be legal. When Dems and Republicans combined it was 60%.
I think the issue is that it's a subject with soft support. I'm sure that 60% do think it should remain legal but for too many it's not their primary issue that they feel strongly about. The people that want it overturned DO feel strongly about it and make their voices known. And that sucks. I'm afraid even if it were overturned too many people wouldn't notice the effect for too long a period of time.

(17,324 posts)The confirmation of an anti-Roe Scalia replacement will not change that.
Should the Ginsberg or Kennedy seats come open, there would be a huge problem.

(17,324 posts)Ginsberg gambled that she could be replaced by the first woman president in Hillary Clinton. Hopefully it is not a bet we pay for over a generation.
