House strikes down mental-health gun rule

The House on Thursday struck down an Obama-era regulation that sought to keep guns out of the hands of the mentally ill.


The House voted 235-180 to roll back an attempt by the Social Security Administration to block disability recipients with mental disorders like schizophrenia and severe anxiety from owning guns.

The rule required reporting people who receive disability benefits and have a mental health condition to the FBI’s background check system. But critics said the restrictions would have also applied to disability recipients who needed financial help managing their benefits.

The National Rifle Association has long opposed the rule.

“The Obama administration’s last minute, back-door gun grab would have stripped law-abiding Americans of their Second Amendment rights without due process,” said Chris Cox, the NRA’s top lobbyist.

House Republicans turned to the Congressional Review Act to overturn the gun regulation. The law allows Republicans to roll back rules they disapprove of without Democratic support.


The House also voted Thursday to strike down the Labor Department’s blacklisting rule, which requires federal contractors to report labor violations.

On Wednesday, the House voted to strike down the Interior Department’s stream protection rule and the Securities and Exchange Commission’s disclosure requirements for oil and gas companies through the Congressional Review Act.

The House is also expected Friday to strike down the Interior Department’s methane emissions standards.


The Senate must approve each of these measures with a simple majority before they are sent to President Trump to sign.

saying that mentally ill people can carry guns into the congressional visitor galleries. Who would ever vote for that?

And that the cause of the mass shootings is mental illness.

Solution?

Allow everyone, including the mentally ill, to purchase whatever weaponry they desire.

Trump ain't the only insane American, folks.

I feel will do nothing but spur on a huge backlash and a strong Democratic Party for the future and future generations.

I must believe this because thinking about the alternative sucks.

NEVER have I been so angry on a daily basis over politics.

"The intent of the rule {was} to bring the Social Security Administration in line with other laws that regulate who gets reported to the National Instant Criminal Background Check System (NICS), a database used to prevent gun sales to excluded classes such as felons, drug addicts, dishonorably discharged service members, fugitives, and illegal immigrants.

The rule would require that the Social Security Administration report to the Attorney General, for inclusion in the NICS, Social Security recipients who have been deemed unable to manage their own affairs due to "marked subnormal intelligence, or mental illness, incompetency, condition, or disease":

Criteria for inclusion in the NICS include that an individual is disabled based on a finding that the individual’s impairment(s) meets or medically equals the requirements of one of the mental disorders listings. These listings consist of medical conditions that we consider severe enough to prevent a person from doing any gainful activity, regardless of age, education, or work experience. Individuals whose impairments meet a listing are the most severely disabled individuals we serve. If we find an individual to be disabled based on a listing-level mental impairment, and he or she satisfies all of the remaining requirements, we are required to report them to the NICS. If we do not find an individual to be disabled based on a mental impairment, he or she has not met the reporting requirements and we will not report them to the NICS.
