9. The poor S.O.B. is probably an assistant U.S. attorney

who got stuck with a steaming turd of a case (they probably drew straws in his office and he got the short one) and can't come up with a decent argument because there aren't any. He's probably been at the job for awhile and might even be a perfectly competent lawyer. Getting a job with the U.S. attorney's office isn't easy and they are usually very capable. But this is a classic case of trying to make a silk purse out of a sow's ear (or Trump's scrotum), and there's just no way to do it.
