Trump drops travel ban, tells 9th Circuit: “the President intends in the near future to rescind the Order and replace it.”

President Donald Trump confirmed Thursday that he plans to revoke and replace his executive order suspending the U.S. refugee program and immigration from some Muslim majority countries as early as next week.

The refugee and travel bans, which unleashed widespread confusion at international airports when the order was signed last month, have been frozen since a federal judge issued a nationwide injunction Feb. 3. A three-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco unanimously upheld the stay last week.

"The new order is going to be very much tailored to what I consider to be a very bad decision," Trump said at a lengthy and, at times, contentious press conference at the White House on Thursday. "But we can tailor the order to that decision and we can get just about everything, and in some ways more."

The president's remarks came shortly after the Justice Department filed a response to the 9th Circuit's ruling, stating that the administration would not seek an en banc review by a full panel of the court.

"Rather than continuing this litigation, the President intends in the near future to rescind the Order and replace it with a new, substantially revised Executive Order to eliminate what the panel erroneously thought were constitutional concerns," the Justice Department wrote in its filing.

... Will now be written by attorneys, with input of the State Department, etc. and will sickeningly probably pass muster this time.

If you note 45 babbled on and on about his executive order was a "Muslim" ban and this was held against him as it proved his intent. 45 is not calling the planned replacement exec order a "Muslim" ban ... although it will be.
