In a letter to Attorney General Eric Schneiderman, the group and four attorneys said that the attorney generals office has the power to revoke the corporate charter from Trumps organization, which has violated laws that prohibit the president from receiving payments from foreign governments.
Schneidermans press secretary Amy Spitalnick told ThinkProgress that the attorney generals office will review the letter.
In an FAQ document, Free Speech for People and attorneys Jonathan S. Abady, Andrew G. Celli, Jr., Ben T. Clements, and Fordham University School of Law Professor Jed Shugerman explain how Schneiderman could bring about a lawsuit.
Under Section 1101 of New Yorks Business Corporation Law, the attorney general can bring an action for the dissolution of a corporation . . . [if] the corporation has exceeded the authority conferred upon it by law, or has violated any provision of law whereby it has forfeited its charter, or carried on, conducted or transacted its business in a persistently fraudulent or illegal manner, or by the abuse of its powers contrary to the public policy of the state has become liable to be dissolved.[/blockquote]

(17,984 posts)I was under the same impression. In fact, I thought the NY AG was all over this and it was in the bag. Here's hoping that it's just taking longer to go through legal channels and not being dropped.

Eric Schneiderman, New York's AG wants to hear from you whether or not you live in NYState. The NY AG wants to investigate Trump's violations of the emoluments clause and wants to hear whether the public supports this idea or not. Again, whether you are a NYer or not -- he is interested in hearing from you on this national issue, both by PHONE and by EMAIL TODAY. (2/24)

The email is nyag.consumerbureau@ag.ny.gov, and mine read simply: "Please investigate President Trump's possible violations of the Emoluments Clause."
