We should be able to travel to any country, assuming we are allowed
in that country, but as American Citizens, we should be able to return
to our home country, embassy, consulate ... without any issues.
This is not the America I grew up in!!!

This administration is a study in how much a country will put up with, and I'm frankly both shocked and fascinated.

Khizr Khan was born in Pakistan but has been a US citizen for 30 years. He and his wife Ghazala took to the stage at the Democratic National Convention last year to describe the loss of their son, Humayun, who died in the Iraq War in 2004.
Sales of the US constitution spiked after he asked Trump if he had ever read it, and he accused the US president of having "sacrificed nothing and no one".
He also described how the "patriots" in Arlington Cemetery who died defending the US were of "all faiths, genders and ethnicities".

I'm not saying the story isn't true, and if it is, it's horrifying. It would confirm EVERYTHING we worried about with these fascists. But I want more sourcing on it before I share it on my social media.

However, this doesn't add up. You can't stop an American citizen from traveling to Canada. There is no such thing as a travel privilege. It doesn't say who is reviewing his ability to travel. Khan offered "no comment."
My guess is that Khan received a prank phone call or email.

(15,366 posts)It would have had a LOT bigger impact if border officials had refused to let him return. After all, Mr. Khan has been a US citizen for over 30 years. So long as he has properly issued and currently valid travel documents, it would have been wholly unconstitutional NOT to let him leave OR return. We are NOT at war with Canada. Yet anyway.
In fact, if he has written proof from a civil servant that his travel privileges are "being reviewed" and it was on that basis that he forewent his speaking engagement, he could have a cause of action under constitutional torts against that civil servant (aka the Trump Administration).
42 USCS § 1983 reads as follows:
Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the U.S. or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer's judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable.

Jump to the section on International Travel (Restrictions) to see that while the Presidential administration may deny or revoke passports for foreign policy or national security reasons at any time, the Secretary of State has historically in times of peace refused passports for one of two reasons, citizenship or loyalty, and criminal conduct or when the applicant was seeking to "escape the toils of law."
Unless any of these reasons can be applied AND meet the "red face" test - and it is clear in these circumstances that one cannot - denial of Mr. Khan's travel to Canada - or to return to the US - would have been unconstitutional.
I am a US citizen who is also a permanent resident of Switzerland and returned here from the US early in Feb. I plan to continue to travel back and forth as long as I have validly issued travel documents.
Woe to any ICE personnel or other Trump Admin flunky who tries to prevent me from doing so!
