I believe that person is an Obama appointee, at least for now.

But yes someone in the DOJ must make an Independent Commission. If not we have lost all hope of democracy.

If it is intended to lead to possible criminal prosecution, the DoJ; but the Senate could also create a select committee, as per Watergate.
