Who appoints an independent investigatory commision?

My understanding is the DOJ does.

How can this be fair considering Jeff Sessions?

But yes someone in the DOJ must make an Independent Commission. If not we have lost all hope of democracy.

If it is intended to lead to possible criminal prosecution, the DoJ; but the Senate could also create a select committee, as per Watergate.
