expected that a loose-tongued, prevaricating, braggadocio tycoon with illegal ties to foreign agents would get weeded out during the electoral process and anyone elected to the highest office of the land would need leeway to do things the average citizen could not (like shoot some pursuing British soldiers while galloping to a convention on horseback) in service of the best interests of America.

You only give power like that to someone you know won't abuse it, and Benedict Don has the impulsive need to push all the buttons just to see what colors they light up.
