He says since no grand jury is empaneled, it does not rise to the level of obstruction of justice. HE says it is an abuse of power, but not obstruction.
I guess he didn't get the Mensch and Carter memos.

Maybe he is right that a the presence of a grand jury matters, but he never mentioned that Comey was then actually FIRED, and Trump stated in an interview that his handled of Trump-Russia was a reason. That seems to change the calculus to me, but I am not a lawyer.

That's how many Senators are required to convict.
It cannot be done without Republicans even if the Democrats win every last Senate race next year.

(62,444 posts)What fascinates me with perceptions of lawyers is that people think the "good ones" are lawyers who spend a lot of time talking on the TeeVee machine. Now, some academics do, but the lawyers who are regularly chosen to spend time on television are not chosen for those appearances based on legal acumen, but on how well they present in that format.

How does TURLEY know that the GJ was not impaneled at that time?
