Judge Tosses Jurys Conviction Of Woman Who Laughed At Jeff Sessions

A D.C. judge tossed out the conviction of a woman arrested after laughing during Sessions’ Senate confirmation hearing.

WASHINGTON ― A D.C. judge has tossed out a jury’s conviction of a protester who laughed during Attorney General Jeff Sessions’ Senate confirmation hearing, finding on Friday that the government had made improper arguments during the trial.

Desiree Fairooz, 61, who was associated with the group Code Pink, had been convicted of disorderly and disruptive conduct and demonstrating inside the Capitol. But Chief Judge Robert E. Morin of the Superior Court of the District of Columbia tossed out the guilty verdict because the government had argued that the laugh in and of itself was enough to warrant a guilty verdict.

Morin said it was “disconcerting” that the government made the case in closing arguments that the laughter in and of itself was sufficient.

“The court is concerned about the government’s theory,” Morin said. He said the laughter “would not be sufficient” to submit the case to the jury, and said the government hadn’t made clear before the trial that it intended to make that argument.

People better wakeup to the fact that Trump has surrounded himself with fascists. Take only one example, Sebastian Gorka. He has American and Hungarian dual citizenship. His claim of holding a Phd is ludicrous being awarded by some people holding BA degrees. While in Hungary he was denied a security to work for the Hungarian government due to his ties to radical anti-sematic groups since he is a member of Vtezi Ramd and has taken a lifetime oath of loyalty. In 2007 he declared his support the Magyar Garda (Hungarian Guard) a neo-fascist group that was banned by the European Court of Human Rights. Democratic Senators, Ben Cardin, Dick Durban and Richard Blumenthal have requested that his citizenship be question since he was a member of a pro-Nazi organization that he failed to disclose in his application.

This is only one example of the fascists that dominate Trump's inner circle. WAKEUP AMERICA!!!!

Going to prison for laughing at an alleged public servant is something that happens under despotism. That's the path we're on.

most of us are a little hypocritical in some ways. Usually in small, not very impactful ways. It's just human nature.

However, the blatant, pernicious hypocrisy of the RW takes it to a new level.

I myself was horrified that the poor woman was arrested and charged with a crime.

It was as if there were a police state in action.

One would think that heartfelt laughter would be considered free speech in our Democracy.

It was not like she was committing any physical violence against the Keebler.

Meanwhile, the hatred filled people among us would certainly argue that the racist and divisive statements that their obsessive groups generate all of the time, are protected by free speech.

The fact that a jury convicted her, based on that argument, worries me more! 12 people couldn't see what this judge saw...and were willing to send this woman to prison...that in and of itself is worse then what the government tried to do!!!

apparently court rules prevented the Judge for 'censoring' the prosecutor's claim that:

both organizations (the US Capitol Police and the DC Superior Court) are creations of the US Congress.

IMO-Sessions is another colluder/LIAR with the Russian & Republican criminals and attacks our Democracy.

in knowing that the rule of law in the end will be upheld. From the beginning of this nightmare called trump i could only place my faith in our judicial system. It is our only remaining saving grace.

hopefully one day soon, Sessions will be in a court while in handcuffs, charged with high crimes and I'll have the opportunity to be in the court to witness it. I will laugh my head off !!

you can't stop laughter just like you can't stop people's self-interest or self-defense

governments compel many things - tax compliance, jury duty, drivers' licenses

I just don't know how or why you can compel the most basic human emotions that
are instinctual, innate, reflexive. This is like trying to suppress the joy that will be felt
when Trump leaves office.
