(6,281 posts)1. There was a hypothesis floated a couple months ago that said yes.
Since Mueller is investigating the details of Comey's firing and Rod was a key player in that drama, the theory goes that he would have to recuse himself from overseeing Mueller since he would like be a witness.
Not sure if that held water but, as with all things in the administration, they'll do what they want and then dare someone to stop them. The question is who can/will do that.

I am not sure who it would go to after the Solicitor General but I imagine it would just follow down the chain of command in DOJ
